96 - 1011 <br />PUBLIC UTILITY EASEMENT <br />INTRAWEST MORTGAGE COMPANY of Denver, Colorado, herein called <br />the Grantor, in consideration of r�fty and no /i00 Dollars <br />receipt of which is hereby acknowledged, here'Dy grants and <br />conveys unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation, in Hall County, Nebraska, .herein called <br />the Grantee, a Permanent and peroetual easement and <br />aintain, extend, repair, replace, and <br />to construct, overate, <br />remove storm .sewers, manholes, and other appurtenances, upon, <br />over, in, and through the easterly four ( 4 ) feet of Lot 12 of <br />Bernhard Voss First Subdivision in Vie City of Grand island, as <br />shown on the Plat dated 12!11;85 marked Exhibit "A" attached <br />hereto and incorporated herein by reference; together with the <br />following rights, namely, unrestricted ingress and egress under, <br />over, and across such land for the purpose of exercising the <br />rights herein granted, to clear and keeo clear of trees, roots, <br />and brush from the surface of such tract. Anv such utilities and <br />an,pu- tenances placed upon, over, and under such tract of land <br />shall remain the prooerty of the Grantee and may be removed or <br />replaced at any time. <br />Any sidewalk or driveway damaged or removed by Grantee in <br />the exercise of the rights granted by this easement shall be <br />replaced by Grantee at Grantee's expense. <br />
