<br />($100,000.00 ), payable in lawful money of the United States which shall be legal tender in payment of all
<br />derma and dues, public and private, at the time of payment, with exchange on the City of New York, payable in
<br />ir>s>lments, the final installment due July 10, 2005 with interest thereon from the
<br />date thereof as therein provided.
<br />And Whereas, Trustor is desirous of securing the prompt payment of said Promissory Note and all interest and
<br />+rti charges thereon, in whose hands soever the same may be.
<br />Y Now, therefore, Trustor, in consideration of the premises, and for the purpose aforesaid, hath granted, bar-
<br />gained, sold, and conveyed, and hereby does grant, bargain, sell and convey unto the Trustee, in trust, with
<br />power of sale, pursuant to the Nebraska Trust Deeds Act (Section 76 -1001 et. seq.), all the following described
<br />real estate, premises and property, situate in the County of Hall and State of Nebraska,
<br />to wit:
<br />The Northwest Quarter of Section 12, Township 11 North, Range 10 West of the Sixth
<br />Principal Meridian, excepting therefrom land described as the Northwest Subdivision
<br />which begins at the northwest corner of the Northwest Quarter of said Section 12,
<br />thence running easterly along the north line of said Northwest Quarter a distance
<br />of 1,123.0 feet, thence running southerly and parallel with the west line of said
<br />Northwest Quarter .a distance of 274.0 feet, thence running westerly and parallel to
<br />the north line of said Northwest Quarter 1,123.0 feet to a point on the west line of
<br />said Northwest Quarter; thence running northerly a distance of 274.0 feet to the
<br />point of beginning, also except beginning at the southwest corner of the Northwest
<br />Quarter of said Section 12,thence running northerly along the west line of said North-
<br />west Quarter a distance of 825.0 feet; thence running easterly and parallel to the
<br />south line of said Northwest Quarter a distance of 300.0 feet; thence running southerly
<br />and parallel to the west line of said Northwest Quarter a distance of 825.0 feet to
<br />a point on the south line of said Northwest Quarter; thence running westerly along
<br />and upon the south line of said Northwest Quartera distance of 300.0 feet to the point
<br />of beginning, also except beginning at a point on the west line of the Northwest Quarter
<br />of said Section 12; said point being 875.0 feet north of the southwest corner of said
<br />Northwest Quarter; thence running northerly along the west line of said Northwest
<br />Quarter a distance of 145.0 feet; thence running easterly and parallel to the south line
<br />of said Northwest Quarter a distance of 300.0 feet; thence running southerly and parallel
<br />to the west line of said Northwest Quarter a distance of 145.0 feet; thence running
<br />westerly and parallel to the south line of said Northwest Quarter a distance of 300.0
<br />feet to the point of beginning, and except the southerly 2,607 feet of the eastern 90
<br />feet of the Northwest Quarter of said Section 12, together with all crops grown thereon.
<br />The note secured hereby expressly provides that the holder thereof may at its option
<br />change or adjust the interest rates set forth therein.
<br />This Deed of Trust is given to secure a deferred purchase money note, which represents
<br />funds advanced by beneficiary to pay for the balance of the purchase price paid to the
<br />grantor for said land and is to be deemed given for the purchase price and the continua-
<br />tion of the original vendor's lien on said premises.
<br />The note secured by this Deed of Trust is further secured by a financing statement and
<br />security agreement of even date herewith covering personal property as described in
<br />said financing statement and security agreement.
<br />It is agreed that all irrigation pumps, electric motors, engines, pipes, sprinklers and
<br />all other irrigation equipment connected therewith now or hereafter placed or installed
<br />on said premises together with all water and watering rights of every kind and deseri.p-
<br />Lion shall. be construed as affixed to and a part of the real estate hereinabove described
<br />and subject to �?Jl of the provisions of this Deed of Trust.
