100833 <br />SURVIVORSHIP WARRANTY DECD <br />EUGENE W. JEFFRES and VIRGINIA A. JEFFRES, each in his and her own right and as hus- <br />band and wife, herein called the grantor whether one or more, in consideration of One Hun- <br />dred Eighty -one Thousand Five Hundred Dollars ($181,500.00) received from grantees, does <br />grant, bargain sell convey and confirm unto MELVIN L. HINZE and MARGARET M. HINZE, husband <br />and wife, as joint tenants with right of survivorship, and not as tenants in cannon, the fol- <br />lowing described real property in Hall County, Nebraska: <br />Tract 1: A tract of land consisting of part of Lot Six (6) of Voss Subdivision of a part of <br />the Southeast Quarter of the Southwest Quarter (SEIASA) and a part of the Southwest Quarter <br />of the Southeast Quarter (SASE%) of Section Eleven (11), Township Eleven (11) North, Range <br />Nine (9) West of the 6th P.M., and more particularly described as follows: First to ascer- <br />tain the actual point of beginning of said tract, start at the Southeast corner of said Lot <br />Six (6), running thence Westerly along the South line of Lot Six (6), a distance of Six Hun- <br />dred Three and Five Tenths Feet (603.5'); thence deflecting right 900 00' and running North- <br />erly a distance of Four Hundred Eighty -eight and Fifty -five Hundredths Feet (488.55') to a <br />point on the Southerly Right -of -Way line of U.S. Highway #30, thence running Northeasterly <br />along and upon said Right -of -Way line a distance of Two Hundred Sixty -five and Seven Tenths <br />Feet (265.7'), thence running Southerly and parallel to the West line of said tract a dis- <br />tance of Six Hundred Six Feet (606.00'); thence deflecting right and 900 00' and running <br />Westerly a distance of Two Hundred Forty Feet (240') to the point of beginning. <br />Tract 2: A tract of land comprising the West Two Hundred Twenty -three Feet (W223') of '-.he <br />East Eight Hundred Twenty-six and Five Tenths Feet (E826.51) of Lot Six (6) of Voss Subdi- <br />vision of part of the Southeast Quarter of the Southwest Quarter (SE�sSA) and part of the <br />Southwest Quarter of the Southeast Quarter (SW4SE') of Section Elven (11), in Township <br />Eleven (11) North, Range Nine (9) West of the 6th P.M., described as: Beginning at a point <br />located on an East -nest line running parallel to and Thirty -three Feet (33') North of the <br />South line of Lot Six (6), Voss Subdivision of part of the Southeast Quarter of the South- <br />west Qaurter (SE�SW') and par*_ of the Southwest Quarter of the Southeast Quarter (SASEh) <br />of Section Eleven (11), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., <br />said point of beginning being Six Hundred Three and Five Tenths Feet (603.5') West of the <br />East boundary of said Lot Six (6); thence running Westerly Two Hundred Twenty -three Feet <br />(223') along said East -West line running parallel to and Thirty -three Feet (33') from said <br />South line of Lot Six (6); thence Northerly along a line perpendicular to said East -West <br />line, Three Hundred Forty -six and Eight Tenths Feet (346.8') to the South boundary of the <br />Southwesterly- Northeasterly Right -of -Way of U.S. Highway #30; thence Northeasterly along <br />said South Right -of -Way boundary, Two Hundred Forty -eight and Fifteen Hundredths Feet <br />(248.15'); thence Southerly along a line perpendicular to said South boundary of Lot Six <br />(6), Four Hundred Fifty -five and Fifty -five Hundredths Feet (455.55') to the point of be- <br />ginning, containing 2.05 acres, more or less. <br />To have and to hold the above described premises together with all tenaments, heredi- <br />taments and appurtanances thereto belonging unto the grantees and to their assigns, or to <br />the heirs and assigns of the survivor of them forever. <br />And grantor does hereby covenant with the grantees and with their assigns and with the <br />heirs and aB signs of the survivor of them that grantor is lawfully seised of said premises; <br />that they are free from encumbrance; that grantor has good right and lawful authority to con- <br />vey the same; and that grantor warrants and will defend the title to said premises against <br />the lawful claims of all persons whomsoever. <br />It is the intention of all parties hereto that in the event of the death of either of <br />the grantees, the entire fee title to this real property shall vest in the surviving grantee. <br />Dated this �r_ day of April, 1973. <br />j <br />i/ <br />r: 3 <br />/ 4 Eugene W. deffres <br />Virginia A.
