19 <br />STATE OF NEBRASKA <br />COUNTY OF HALL <br />86-- 1006x"' <br />A F F I D A V I T <br />I, Charles B. Beer, being first duly sworn upon oath, deposes and says, <br />1. Affiant is a Registered Land Surveyor in the State of Nebraska, and <br />is now a partner in the firm of Rockwell -Beer, Engineering & Surveying, <br />Grand Island., Nebraska. <br />2. Affiant further states that on June 10, 1970, he completed a survey <br />of Babel Subdivision,, Hall County., Nebraska., and that the original <br />plat of said subdivision is now recorded at the Register of Deeds office <br />in the Hall County Courthouse at Grand Island., Nebraska.. <br />3. Affiant further states that he has this date re- examined said plat <br />of Babel Subdivision, and has discovered an error which affects the <br />East and south boundaries of Lot Two (2), Babel Subdivision. <br />4. Affiant further states that the angles and distances affected by this <br />error should be as shown on the sketch attached to this affidavit in <br />lieu of those shown on the original plat. <br />5_ Affiant fur`.her states that the Legal Description on said original <br />plat of Babel Subdivision is erroneous, null and void, and should be <br />replaced by the following legal description: <br />A tract of land comprising a part of the East Half of the Southeast <br />Quarter (E' SE4) of Section Seven (7), Township Nine (9) North, Range Eleven <br />(11) West of the 6th P-M. in Hall County, Nebraska, more particularly described <br />as follows: <br />Beginning at the northeast corner of said Southeast Quarter (SE;,); <br />thence southerly along the east line of said Section Seven (7), a distance <br />of One Thousand Six Hundred Eight and Eight Tenths (1,608..8) feet; thence <br />deflecting right 900 00' and running westerly, a distance of Forty Nine <br />and One Hundredth (49.01) feet to a point on the westerly highway right -of -way <br />line, this being the ACTUAL place of beginning; thence deflecting right <br />80 24' 04" and running northwesterly along said right -of -way line, a distance <br />of Five and Eighty Eight Hundredths (5.88) feet; thence deflecting right <br />090 35' 56" and running northerly along said right -of -way line., a distance <br />of Two Hundred Sixteen and Two Tenths (216.2) feet; thence deflecting left <br />690 41' and running northwesterly along the 1 -80 right -of -way line, a distance <br />of Five Hundred Thirty Two and Six Tenths (532..6) feet to a point of curvature; <br />thence running northwesterly along the arc of a curve whose radius is 718_5 <br />feet; (initial tangent of which coincides with the last described course <br />produced), and on said 1 -80 right -of -way line, a distance of Four Hundred <br />Ninety One (491.0) feet; thence southwesterly along the final tangent of <br />the last described curve produced, a distance of Five and Ninety Three <br />Hundredths (5_93) feet; thence running southerly parallel to the east line <br />of said Southeast Quarter (SEAL), a distance of Four Hundred Eleven and <br />Twenty Four Hundredths (411.24) feet; thence deflecting left 900 00' and <br />running easterly, a distance of Nine Hundred Eighty Seven and Forty Nine <br />Hundredths (987_49) feet to the ACTUAL place of beginning and contain' � -1 <br />8.498 acres more or less. t.T. - �_ <br />Further Affiant Saith Not. <br />Ls• w': <br />Charles B.
