<br />-RELEASE AND RECONVEYANCE OF EASEMENT
<br />WHEREAS, on September 22, 1971, Spelts - Schultz Lumber
<br />Co. of Grand Island, a corporation, and spelts of Nebraska,
<br />inc., a corporation, (Grantors), conveyed a deed of easement
<br />to Burl M. Hooker and Frances C. Hooker, husband and wife, and
<br />Raymond L. Hooker and Wilda I. Hooker, husband and wife, (Grantees),
<br />which deed of easement was recorded in the office of the Register
<br />of Deeds of Hall County, Nebraska, on September 27, 1971, in
<br />Book 165, of Deeds, at Page 457, and
<br />WHEREAS, said Grantees conveyed said easement on August 27,
<br />1979, to R. W. Giesenhagen and Helen L. Giesenhagen, husband and
<br />wife, by survivorship warranty deed which was recorded in the
<br />office of the Register of Deeds of Hall County, Nebraska, on
<br />October 7,'1985, as document #%85- 004924, and
<br />WHEREAS, said R. W. Giesenhagen and Helen L. Giesenhagen
<br />no longer require such easement and they do hereby desire to
<br />relinquish all right, title and interest which they, their
<br />heirs and assigns may have in and to the aforesaid easement
<br />and to reconvey said easement to Spelts - Schultz Lumber Co. of
<br />Grand Island, a corporation,
<br />NOW, THEREFORE, for good and valuable consideration, not
<br />herein recited but hereby acknowledged, the undersigned R. W.
<br />Giesenhagen and Helen L. Giesenhagen, hereby relinquish and
<br />release all of their right, title and interest in and to the
<br />easement recorded in Book 165 of deeds, at Page 457 thereof,
<br />in the office of the Register of Deeds of Hall County, Nebraska,
<br />and they hereby reconvey such easement of Spelts - Schultz Lumber
<br />Co. of Grand Island, a corporation.
<br />Said R. W. Giesenhagen and Helen L. Giesenhagen, husband
<br />and wife, further convenant that they are lawfully seized of
<br />such easement, that it is free from encumbrances, that they
<br />have legal power and lawful authority to convey the same and
<br />they warrant and will defend the title to the aforesaid easement
<br />against the claims of all persons claiming the same or any part
<br />thereof by, through or under said R. W. Giesenhagen and Helen L.
<br />Giesenhagen.
