MEMORANDUM OF RENTAL POOL AGREEMENT `^' — 100484 This Memorandum of Rental Pool Agreement ( "Memorandum "), made and entered into as of this 30th day of SDecember, 1985, by and between the undersigned purchaser of a condominium apartment unit(s) ( "Owner ") and Devco Investment Corporation, a Nebraska corporation ( "Agent "), is made with reference to the following: A This Memorandum is to indicate that the Owner and Agent executed a Rental Pool Agreement. dated Q Ar. v 1% 1 , 1985, for The Yancey Condominium, Grand Island, Nebraska, encumbering the real estate described, to- wit (the "Unit "): Condominium Units) No. 56 The Yancey, a Condo- minium, a Condominium in accordance with the Declaration recorded on October 17, 1984, under Document No. 84- 005507 of the County of Ball, State of Nebraska, records. B. A copy of an unexecuted Rental Pool Agreement is incorporated as Exhibit "D" to the Declaration, recorded on October 3.7, 1984, under Document No. 84- 005507 of the County of Lancaster, State of Nebraska, records. C. The Rental Pool Agreement executed by the Owner and Agent states that until June 30, 1.990, the Unit(s) shall be rented, leased and subleased through and placed in the The Yancey rental pool in accordance with the terms and conditions as defined in the Rental Pool Agreement. D. The Rental Pool Agreement also states that unless the Owner reserves the right to have the Unit(s) occupied by the Owner or the Owner's immediate family, business clients or employees (hereinafter referred to as "Personal Use "), the Owner shall participate in the rental pool subject to certain terms and conditions a defined in the Rental Pool Agreement. The Owner designates the Agent as the exclusive agent on behalf of the Owner to manage the rental, leasing and subleasing of the Unit(s) until June 30, 1990, subject to the terms and conditions as defined in the Rental Pool Agreement. F. All notices, demands, inquiries or documents that are permitted or required to be given or served hereunder shall be in writing and shall be served by certified or registered mail, posting prepaid to the Owners at the address appearing below, and to the Agent at the address appearing below. Such addresses may be changed from time to time by either party by serving notice as provided above.
