NOTICE OF DEFAULT <br />TO WHOM IT MAY CONCERN: <br />85-- 1004138 <br />WHEREAS, Kirk G. Arnold and Manila D. Arnold, Trustor, on the <br />14th day of July, 1983, made, executed and delivered to American Charter <br />Federal Savings and Loan Association, Trustee, a Deed of Trust conveying <br />the following real estate: <br />Lot Five (5), in Block One Hundred and Thirty -Eight <br />(138) of Union Pacific Railway Company's Second <br />Addition to the City of Grand Island, Hall County, <br />Nebraska. <br />WHEREAS, the Deed of Trust was given as security for the payment <br />of a Home Access Note made by the Trustor on the same date to American <br />Charter Federal Savings and Loan Association, a corporation, Beneficiary, <br />and the Deed of Trust was recorded on the 15th day of July, 1983, in the <br />office of the Register of Deeds of Hall County, Nebraska, as Instrument <br />No. 83- 003749 and, <br />WHEREAS, a breach of the obligation of the Trustor for which the <br />Deed of Trust was made has occurred by failure of the Trustor to make <br />payments due on September 1, 1985, October l,985, November 1, 1985, <br />December 1, 1985, and January 1, 1986, under the terms of the Home Access <br />Note given to the Beneficiary by the Trustor; <br />THEREFORE, notice is hereby given that the undersigned Trustee, <br />at the request of the Beneficiary, has elected to consider all of the <br />Principal and Interest due in consequence of this default and has elected <br />to sell the real estate described in the Trust Deed to satisfy this <br />obligation. _Q <br />Dated thiw day of January, 1986. <br />AMERICAN CHARTER FEDERAL SAVINGS AND <br />LOAN ASSOCIATION, Trustee <br />By: WHELAN, FOOTE & SCHERR, P.C. <br />Itv)Wtorneys .n <br />B <br />1 Werner - Whelan Plaza <br />1pO.
