<br />Douglas Oakeson, President of City National Bank and Trust
<br />Company, Hastings, Nebraska, (hereinafter referred to "City
<br />National), being first duly sworn, deposes and says as follows:
<br />1. That on and prior to October 23, 1985, City National was
<br />the Mortgagee on three Mortgages which were filed with the
<br />Register of Deeds of Hall County, Nebraska, which Mortgages granted
<br />City National a mortgage lien in, with other property, the South-
<br />east Quarter of Section Thirty -six, Township Nine North, Range Nine
<br />West of the 6th P.M., Hall County, Nebraska; that the Mortgages
<br />referred to herein were filed in the office of the Register of Deeds
<br />of Hall County, Nebraska on February 18, 1977 as Instrument No.
<br />77- 000827, on September 25, 1981 as Instrument No. 81- 004876, and
<br />on May 17, 1983 as Instrument No. 83- 002449.
<br />2. That pursuant to an agreement with the Mortgagor, City
<br />National was to release certain property described in the above
<br />referenced Mortgages, but City National was to retain the liens
<br />created by the above referenced Mortgages as the same pertained to
<br />the Southeast Quarter of Section Thirty -six, Township Nine North,
<br />Range Nine West of the 6th P.M., Hall County, Nebraska.
<br />3. On October 23, 1985, the undersigned, on behalf of City
<br />National, executed three releases, one with respect to each of the
<br />above three Mortgages, and those releases were filed in the office
<br />of the Register of Deeds of Hall County, Nebraska on October 24,
<br />1985 as Instrument Nos. 85- 005334, 85- 005335 and 85- 005336; that
<br />said releases purported to be given in consideration of "the payment
<br />of the debt named therein" and purported to be full releases of the
<br />mortgage lien; that said releases were prepared in error and, in
<br />fact, they should have been partial releases given in consideration
<br />of "the partial payment of the debt named therein" and should not
<br />have released the lien as to the Southeast Quarter of Section
<br />Thirty -six, Township Nine North, Range Nine West of the 6th P.M.,
<br />Hall County, Nebraska.
<br />4. That by virtue of the mistake referred to above, City
<br />National hereby gives notice that they still claim a valid mortgage
<br />lien with respect to the Southeast Quarter of Section Thirty -six,
<br />Township Nine North, Range Nine West of the 6th P.M., Hall County,
<br />Nebraska as set out in the above referenced Mortgages which were
<br />filed in the office of the'Register of Deeds of Hal]. County,
<br />Nebraska as Instrument Nos. 77- 000827, 81- 004876 and 83- 002449.
<br />Further affiant saieth not.
