THIS AGFtEEhENT is entered into this Ze day of 1A 19 ", between THE CITY OF GRAND ISLAND, a municipal cUrporation, s Licensor-, and FRANC } S, a single person, as Licensee - AS, :Licensee is the owner of residential real estate cognronly referred to as 301 East 3rd Street, Grand Island, Nebraska, and legally described as: Westerly Two- thirds (2 /3) of Lot Four (4), Block Sixty -nine (69), Driginal Town ofthe City of brand Islann, Hail County, Nebraska: and, WHEREAS, a residential structure, having been constructed many years ago, exists an the west side of said property and has a bay window that encroaches into the City right -of -way for approximately 0.5 Feet as shown on Exhibit "A ", attached hereto and incorporated herein by reference' and WHEREAS, Licensor will permit said encroachment to continue under the following terms and conditions. NOW, THEREFORE, IT IS MUTUALLY AGREED: 1. Licensor hereby grants to Licensee, a license to occupy that portion of the City right- of-way tar, Kimball Avenue as shown on Exhibit "A" with the residential structure with bay window presently located thereon Said Licensee may not enlarge said structure or bay window and create a greater encroachment into the public right -of -way. but Licensee may maintain, repair and improve the existing structure and bay window in its present location. 3. This licensee agreement shall terminate automatically upon one or more of the following occurrences: a. Thirty days written notice by either party: b. if said structure is damaged, destroyed, or removed. whether by an act of the licensee, third parties, or an Act of God. 4.
