THIS AGFtEEhENT is entered into this Ze day of 1A <br />19 ", between THE CITY OF GRAND ISLAND, a municipal cUrporation, s <br />Licensor-, and FRANC } S, a single person, as Licensee - <br />AS, :Licensee is the owner of residential real estate cognronly <br />referred to as 301 East 3rd Street, Grand Island, Nebraska, and legally <br />described as: <br />Westerly Two- thirds (2 /3) of Lot Four (4), <br />Block Sixty -nine (69), Driginal Town ofthe City of <br />brand Islann, Hail County, Nebraska: and, <br />WHEREAS, a residential structure, having been constructed many <br />years ago, exists an the west side of said property and has a bay <br />window that encroaches into the City right -of -way for approximately 0.5 <br />Feet as shown on Exhibit "A ", attached hereto and incorporated herein <br />by reference' and <br />WHEREAS, Licensor will permit said encroachment to continue under <br />the following terms and conditions. <br />NOW, THEREFORE, IT IS MUTUALLY AGREED: <br />1. Licensor hereby grants to Licensee, a license to occupy that <br />portion of the City right- of-way tar, Kimball Avenue as shown on Exhibit <br />"A" with the residential structure with bay window presently located <br />thereon <br />Said Licensee may not enlarge said structure or bay <br />window and create a greater encroachment into the public right -of -way. <br />but Licensee may maintain, repair and improve the existing structure <br />and bay window in its present location. <br />3. This licensee agreement shall terminate automatically upon <br />one or more of the following occurrences: <br />a. Thirty days written notice by either party: <br />b. if said structure is damaged, destroyed, or <br />removed. whether by an act of the licensee, <br />third parties, or an Act of God. <br />4. Upon the termination ref this license agreement, the licensee <br />shall be required, and hereby agrees, to remove said structure and <br />bay window from the right -of -way at his own expense and without <br />cost to the City. said removal to occur no later than sixty days after <br />receipt of the notice of termination or si),ty days after this license <br />agreement has Otherwise terminated under raragraoh .'r above. <br />L <br />V <br />r <br />ado:: <br />
