86 - 100' _.7 <br />Agreement as recorded as Document No. 84- 005508 as modified by <br />this Agreement; <br />WHEREAS. Guarantor executed a Second Arter Guarantee, dated <br />June 6, 1985 ( "Second Guarantee ") in favor of the Lender or the <br />holders of the Original Promissory Note and Second Promissory <br />Note, which is incorporated herein by this reference; <br />WHEREAS, Borrower executed other "Loan Documents" dated June <br />6, 1985 as that term is defined in the First Amendment to Con- <br />struction Loan Agreement in favor of the Lender or its holder <br />( "Readvanced Loan Documents ") which Readvanced Loan Documents are <br />incorporated herein by this reference; <br />WHEREAS, the Borrower may pay a refinancing fee of 1/4 of <br />one percent (1%) of the unpaid loan balance on September 30, 1985 <br />to extend the Second Promissory Note to December 31, 1985; <br />WHEREAS, the Lender has agreed to further extend the Second <br />Promissory Note maturity date to March 31, 1986 upon the payment <br />of a refinancing fee; <br />VHEREAS, this Agreement modifies the Deed of Trust; and <br />WHEREAS, Borrower and Lender desire to redefine the term <br />y� <br />"Loan Documents" as that term was defined in the Original Agree- <br />ment, Original Promissory Note, Deed of Trust, Original Guar- <br />antee, and Original Loan Documents. <br />NOW THEREFORE, Lender and Borrower agree as follows: <br />1. New Definition of Loan Documents.
