96— to IG <br />Agrorment as recorded as Document No. 34- 005501 as modified by <br />this Agrent <br />k7MEREAS, Guarantor executed .a Second Arter Guarantee, dated <br />.;une 6, 1985 ("Second Guarantee") in favor of the Lender or the <br />holders of the Original Promissory Dote and Second Promissory <br />Note, which is incorporated herein by this reference; <br />WHEREAS, Borrower executed other '''Loan Documents''' dated June <br />6, 1985 as that term is defined in the First Amendment to Con- <br />struction Loan Agreement in favor of the Lender or its holder <br />( "Readvanced Loan Documents ") which Readvanced Loan Documents are <br />incorporated herein by this reference; <br />WHEREAS, the Borrower executed a promissory note dated March <br />31, 1985 to the order of the Lender to secure the extension of <br />the maturity date of the Original Promissory Note to June 30, <br />1985 and paid a refinancing fee equal to 1/4 of one percent (7) <br />of the principal loan balance on March 31, 2985; <br />WHEREAS, the Borrower executed a promissory note dated June <br />30, 1985 to the order of the Lender to secure the extension of <br />the maturity date of the Original Promissory ?rote to December 31, <br />1985 and paid a refinancing fee equal to 1/4 Oi one percent (11) <br />of the principal loan balance on June 30, 2985; <br />WHEREAS, this Agreement modifies the Deed of Trust; and <br />WHEREAS, Borrower and Lender desire to redefine the tern: <br />"Loan Documents" as that term was defined in the Original Agree- <br />ment, Original Promissory Dote, Deed of Trust, Original Guar - <br />antee, and Original Loan.
