F- <br />WARRANTY DEED 87— sos97e <br />Bender, Inc., Grantor, in consideration of Ten Dollars ($10.00) and Other Good <br />and Valuable Consideration received from Grantee, conveys to Grantee <br />FirsTier Bank, National-Association, Omaha, Nebraska, a <br />National Banking Association organized under the laws of the <br />United States, <br />the following described real estate (as Defined in Nebr. Rev. Stat. 76 -201): <br />North Eighty (80) feet of Lot Four (4) and the North Eighty (80) <br />feet of the West Sixteen (16) feet of Lot Three (3), Block One <br />Hundred Twenty Eight (128) in Union Pacific Railway Company's <br />Second (2nd) Addition to the city of Grand Island, Hall County, <br />Nebraska. <br />Grantor covenants with Grantee that Grantor: <br />(1) is lawfully seized of such real estate and that it is free <br />from all encumbrances except easements, covenants, and <br />restrictions of record; <br />(2) has legal power and lawful authority to convey the same; <br />(3) warrant and will defend title to the real estate against the <br />lawful claims of all persons. <br />This deed is an absolute conveyance, the grantor(s) having sold said land to the <br />Grantee for a fair and adequate consideration, such consideration, in addition to <br />that above recited, being full satisfaction of all obligations secured by the <br />mortgage executed by Bender, Inc., to Commercial National Bank & Trust Company <br />(as mortgagee) recorded as Document No. 82- 0041444, Official Records of Hall <br />County, and the note secured thereby, and the corrected mortgage executed by <br />Bender, Inc., to Commercial National Bank and Trust Company to secure $70,000.00 <br />and dated September 24, 1982 and re -filed October 7, 1982 in the Register of <br />Deeds Office, Hall County, Nebraska as Document # 82- 004348. <br />Grantor declares that this conveyance is freely and fairly made, and that there <br />are no agreements, oral or written, or other than this deed between Grantor(s), <br />and Grantee with respect to said land. <br />It is the express intent of the Grantor and Grantee that the interest in the fee <br />title to the real estate and the interest in any Mortgage affecting this real <br />estate shall remain separate and distinct interests, although now vested in the <br />same entity. <br />Executed 19 <br />NEBRASKA DOCUMENTARY <br />STAMP TAX <br />DEC 31987 <br />BY <br />Bender, Inc. <br />Title: <br />�TgrEMEMT A��HED <br />IN <br />
