F <br />87-- 106976 <br />AGREEMENT BETWEEN CO- OWNERS <br />FOR MAINTENANCE AND REPAIR OF COMMON EASEMENT <br />THIS AGREEMENT made the 1,4,1 day of , 1982, <br />between CLIFFORD L. RUZICKA and LORA B. RUZICKA, Husband and Wife, <br />of 1314 West Division, Grand Island, Nebraska, and WILLIAM H. <br />KELLOGG and MARIE E. KELLOGG, Husband and Wife, of 1310 West <br />Division, Grand Island, Nebraska, WITNESSETH: <br />WHEREAS, the parties hereto are co- owners of an Easement in <br />the nature of a common garage located upon the northeast corner <br />of Lot Seven (7), Block One (1), Elm Place, currently owned by <br />Clifford L. Ruzicka and Lora B. Ruzicka, Husband and wife, and <br />the northwest corner of Lot Eight (8), Block One (1), Elm Place, <br />currently owned by William H. Kellogg and Marie E. Kellogg, Husband <br />and Wife, as more fully shown on the attached Plot Plan hereby made <br />a part of this Agreement; <br />NOW, THEREFORE, the parties hereto agree to share, on an <br />equal basis, all costs of repair and maintenance necessary to <br />maintain the common garage in as good a condition as the same <br />exists on the date of this Agreement. <br />The parties further agree that in the event the structure <br />is damaged or destroyed to such an extent that repair or replace- <br />ment would be equal to or exceed fifty percent (50%) of the value <br />of the property on the date of its damage or destruction, the <br />parties are hereby relieved of any further obligation to each <br />other for the repair or replacement of the structure. <br />J <br />f <br />
