OLIVER, residents <br />of Grand Island, Hall County, Nebraska, and as additional security <br />for repayment of a Note to the FIRST NATIONAL BANK of Wayne in the <br />sum of $ 45,000.00 according to the terms of said Note which <br />is dated November 2, 1987 , 1987, hereby assigns to Bank the <br />rents of the property legally described as: <br />NW} (except 28.421 acres, more or less, described on plat recorded in Miscellaneous <br />Records W -1, Page 273; and except public road right of way described in Book 14, <br />Page 245) Sec. 27, Twp. 10 N, Rg. 12 W 6th P.M. in Hall County, Nebraska, containing <br />131.579 acres, more or less. <br />provided the Olivers shall,prior to acceleration under the terms of <br />the Note which is secured hereby or abandonment of said real estate, <br />have the right to collect and retain such rents as they become due <br />and payable. <br />Upon acceleration of the said Note described above or <br />abandonment of the property, the Bank, in person, by agent or by <br />judicially appointed receiver, shall be entitled to enter upon, take <br />possession of and manage the property and collect the rents of the <br />property, including those past due. All rents collected by the Bank <br />or the receiver shall be applied first to the payments of cost and <br />management of the property and collection of rents, including, but <br />not limited to, receiver's fees, premiums on receiver's bonds and <br />reasonable attorney's fees, and then to the unpaid balance on the Note <br />described above. The Bank and the receiver shall be liable to account <br />for only those rents actually received. For the purpose of this <br />Assignment of Rent, the term rent shall include all income from the <br />real estate described above of any nature, including crops grown by <br />the Olivers, rents, whether cash or shares and any government payments. <br />Dated this 2nd day of November , 1987. <br />C-c <br />J es H.
