PREFACE 06670 TO 87-- <br />MORTGAGE <br />Each of the undersigned, jointly and severally, does <br />rhereby acknowledge that: <br />1. Each of the undersigned has agreed to act as <br />Mortgagor in the MORTGAGE to which this writing is the <br />Preface and wherein EVELYN DIEKMAN is the Mortgagee and <br />which is hereinafter referred to as the Mortgage. <br />2. Each of the undersigned knows that by virtue <br />of the statutes of the State of Nebraska each of us has the <br />right to make a Designation of Homestead in the body of the <br />Mortgage. <br />3. EACH OF THE UNDERSIGNED DOES HEREBY DISCLAIM <br />THE RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF <br />THE MORTGAGE. <br />4. Each of the undersigned does hereby state <br />that no part of our homestead is presently or in the future <br />will be situated upon the real estate described in the <br />Mortgage. Each of the undersigned understands this to mean <br />that whether or not the undersigned is presently residing <br />upon the real estate described in the Mortgage and whether <br />or not each of the undersigned hereafter establishes residence <br />and a homestead upon any part of that real estate during the <br />time that the Mortgage remains unsatisfied and a lien upon <br />the real estate, EACH OF THE UNDERSIGNED SHALL HAVE NO RIGHT <br />TO MAKE P_ DESIGNATION OF HOMESTEAD in the event of foreclosure <br />sale under the provisions of the Mortgage. <br />5. EACH OF THE UNDERSIGNED DOES HEREBY WAIVE BY <br />THIS WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A <br />DESIGNATION OF HOMESTEAD UPON ANY PART OF THE REAL ESTATE <br />DESCRIBED IN THE MORTGAGE. Each of the undersigned understands <br />that the execution of this acknowledgment constitutes the <br />waiver of rights otherwise available for the purpose of <br />affording each of the undersigned the opportunity to retain <br />our homestead in the event of a default upon the Mortgage. <br />6. Each of the undersigned represents that this <br />Preface to Mortgage constitutes a disclaimer of right to <br />make a Designation of Homestead and a waiver of right to <br />make a declaration of homestead as provided for in paragraphs <br />3(a) and 3(b) of section 4 of the Nebraska Farm Homestead <br />Protection Act. Each of the undersigned directs that this <br />Preface shall be filed for record as a part of the Mortgage <br />in the office of the Register of Deeds. <br />This Preface is being signed by me as the Mortgagor in <br />the Mortgage of which this Preface is a part. <br />Signed this day of November, 1987. 19 <br />Li a E.
