87. 106668 <br />SURVIVORSHIP WARRANTY DEED <br />EVELYN DIEKMAN, a single person, herein called the <br />( Grantor, in consideration of ONE AND N01100 DOLLARS ($1.00) <br />received from Grantees, does grant, bargain, sell, convey <br />and confirm unto DONALD E. "GENE" GRAVES and BARBARA GRAVES, <br />husband and wife, as joint tenants with right of survivor- <br />ship and not as tenants in common, herein called the Grantees, <br />the following described real estate in Hall County, Nebraska, <br />described upon Exhibit A, attached hereto and made a part <br />hereof by this reference. <br />TO HAVE AND TO HOLD the above described premises <br />together with all tenements, hereditaments and appurtenances <br />thereto belonging unto the Grantees and to their assigns, or <br />to the heirs and assigns of the survivor of them forever. <br />And Grantor does hereby covenant with the Grantees that <br />Grantor is lawfully seized of said premises; that they are <br />free from encumbrance, except easements of record; that <br />Grantor has good right and lawful authority to convey the <br />same; and that Grantor warrants and will defend the title to <br />said premises against the lawful claims of all persons <br />whomsoever. <br />Grantor hereby reserves to herself, personally, a <br />temporary easement to enter upon the real estate conveyed <br />hereby for the purpose of the non - exclusive use of the irri- <br />gation well, pump and electric motor now located thereon and <br />to pump and convey irrigation water from the present loca- <br />tion of the irrigation well through above ground irrigation <br />pipe (and not by ditch) to the 45 acres, more or less, of <br />real estate owned by Grantor and located adjacent to and <br />north of the real estate conveyed by this deed. All expense <br />of the use of this easement shall be borne by Grantor and <br />Grantees shall have no duty to maintain the well, pump or <br />motor for Grantor. This easement shall expire upon the <br />earlier of (i) the irrigation well's becoming unusable for <br />any reason not the fault of Grantees or (ii) the sale by <br />Grantor of any portion of the 45 acre tract to be served by <br />this easement or (iii) Grantor's death. <br />It is the intention of all parties hereto that in the <br />event of the death of either of the Grantees, the entire fee <br />simple title to the real estate shall vest in the surviving <br />Grantee. <br />Dated this _— day of November, 1987. <br />Eve Di cman <br />STATE OF NEBRASKA ) <br />(ss: <br />COUNTY OF HALL ) <br />Before me, a Notary Public for said County, personally <br />came Evelyn Diekman, known to me to be the identical person <br />who signed the foregoing instrument and acknowledged the <br />execution thereof to be her voluntary act and deed. <br />Witness my hand and Notarial Seal on November, 1987. <br />� ,1tM1 tf I�ki <br />C11ERY1 A.
