<br />and 00 /100 Dollars, in consideration of which the undersigned hereby grant
<br />and convey unto said Grantee, its associated and allied companies, its and
<br />their respective successors, assigns, lessees and agents a right of way and
<br />easement to construct, operate, maintain, replace and remove such
<br />communication systems as the grantees may from time to time require,
<br />consisting of underground cables, lightguides, wires, conduits, manholes,
<br />drains, splicing boxes, repeaters, repeater housings, together with surface
<br />testing- terminals, markers, and other appurtenances, upon, over and under a
<br />strip of land 16.5 feet wide across the land which the undersigned own or in
<br />which the undersigned have any interest in, to -wit:
<br />The North Half (N 1/2) of Section 5, Township 11 North, Range 9
<br />West of the 6th P.M., Hall County, Nebraska.
<br />The south Half (S 1/2) of Section 5, Township 11 North, Range 9
<br />West of the 6th P.M., Hall County, Nebraska EXCEPTING THEREFROM
<br />that part described as follows:
<br />A tract of land in the Southeast Quarter of Section 5,
<br />Township 11 North, Range 9 West of the 6th Principal Meridian, Hall
<br />County, Nebraska, for civic purposes, more particularly described
<br />as follows: Commencing at a point forty and three - tenths feet west
<br />on the southerly line of said Southeast Quarter; thence continuing
<br />westerly on the southerly line of said Southeast Quarter a distance
<br />of seven hundred fifty -five and seven- tenths feet to a point on the
<br />westerly right -of -way line of Grand Island Avenue, extended; thence
<br />in a northerly direction and parallel to the easterly line of said
<br />Southeast Quarter a distance of nine hundred eight -eight and
<br />seventeen hundredths feet to a point on the southerly right -of -way
<br />line of Nebraska Highway No. 2; thence deflecting right one hundred
<br />five degrees and forty -nine minutes and in a southeasterly
<br />direction along the southerly right -of -way line of Nebraska Highway
<br />No. 2 a distance of twenty -seven and ninety -eight hundredths feet
<br />to a point of curvature; thence along the arc of a one thousand one
<br />and seventy -four hundredths foot radius curve to the right, initial
<br />tangent to coincide with the last described course, a distance of
<br />one thousand two hundred ninety -six and one -tenth feet; thence on
<br />tangent and in a southerly direction a distance of twenty -six and
<br />four- tenths feet to the point of beginning and containing twelve
<br />and eighty -five hundredths acres, more or less.
<br />Exhibit 1 is attached hereto and incorporated herein.
<br />Township of Washington, County of Hall, and State of Nebraska together with
<br />the following rights: Of ingress and egress to, from, and along lands
<br />adjacent to said strip for the purpose of constructing and maintaining
<br />communication systems within said strip; to place surface markers beyond said
<br />strip; to clear and keep cleared all trees, roots, brush and other
<br />obstructions from the surface and subsurface of said strip and during
<br />construction to cut all trees within ten feet thereof; and to install gates
<br />in any fences crossing said strip.
<br />The Northerly & Easterly boundary of said 16.5 feet strip shall be a line
<br />parallel to and 5 feet north and east of the first cable or lightguide laid,
<br />which cable or lightguide stLall have its location indicated upon the surface
