7 6 <br />AO EMENT <br />WHEREAS, Richard S. Erickson and June L. Erickson, Husba <br />and Wife, hereinafter referred to as "Party of the First <br />Part ", are the owners of the following described real estate: <br />Lot Thirteen (13), Island Acres No. 7, Subdivision <br />of part of Fractional Section Seven (7); a part of the <br />West Half of the West Half (WJ WJ) of Section Eight <br />(8); and part of Lot Twenty Four (24), Island Acres, <br />all in Township Eleven (11) North, Range Nine. (9) West of <br />the 6th P.M., Hall County, Nebraska. <br />AND, WHEREAS, Virginia A. Jeffres, a single person, <br />hereinafter referred to as the "Party of the Second Part ", <br />is the owner of the following described real estate: <br />Lot Twelve (12) in Island Acres No. 7, Subdivision of <br />part of Fractional Section Seven (7);,a part of the <br />West Half of the West Half (W} WD of Section Eight <br />(8); and part of Lot Twenty Four (24), Island Acres, <br />all in Township Eleven (11) North, Range Nine (9) West <br />of the 6th P.M., Hall County, Nebraska. <br />AND, WHEREAS, the Party of the Second Part has by mistake <br />built a fence running north and south across the Westerly <br />side of the land of the Party of the First Part and enclosing <br />a part thereof with the said land of the Party of the Second <br />Part: <br />NOW it is hereby agreed as follows: <br />1. The Party of the Second Part admits that the true <br />boundary line between her said land and the said land of <br />the Party of the First Part is not represented by the location <br />of the fence, in that the said fence stands upon the said <br />land of the Party of the First Part. <br />2. The Party of the First Part agrees that the Party <br />of the Second Part may without further license on her part <br />use and enjoy all that portion of the said land of the Party <br />of the First Part which lies west from the said fence until <br />this Agreement shall be determined, and in the meantime may <br />maintain the said fence where it now is. <br />3. In consideration of the foregoing, the Party of the <br />Second Part will in every year during the continuance of <br />this Agreement pay to the Party of the First Part the sum <br />of One Dollar ($1), if demanded, as an acknowledgement that <br />the enjoyment of the said land is under this Agreement, and <br />not otherwise. <br />4. The Party of the First Part may terminate this Agreement <br />at any time by giving thirty (30) days' notice in writing <br />to that effect to the Party of the Second Part, and there upon <br />the Party of the Second Part shall immediately remove the <br />d <br />
