<br />NOTICE OF LIS PENDENS
<br />You are hereby notified that on the wZP day of
<br />October, 1987, The Equitable Building and Loan Association, a
<br />Nebraska corporation, Plaintiff, filed its Petition in the
<br />District Court of Hall County, Nebraska against Philip D. Horak
<br />and Linda Susan Horak, husband and wife, et al., Defendants, the
<br />object and prayer of which is to foreclose a certain mortgage of
<br />$28,698.17, plus accruing interest thereon at $8.92 per diem,
<br />commencing October 17, 1987, on the following described real
<br />estate, to -wit:
<br />A portion of the Northeast Quarter of the Southeast
<br />Quarter (NE}SEJ) of Section Two (2), Township Twelve
<br />(12) North, Range Ten (10), West of the 6th P.M., Hall
<br />County, Nebraska, more particularly described as
<br />follows: Beginning at the Northeast corner of said
<br />Northeast Quarter of the Southeast Quarter (NE}SEJ) and
<br />running West along the North line of said Northeast
<br />Quarter of the Southeast Quarter (NEISE#) a distance of
<br />660.02 Feet; thence a deflecting angle left 134 045120"
<br />and running 929.42 Feet Southeasterly to a point on the
<br />East line of said Northeast Quarter of the Southeast
<br />Quarter (NEJSEJ); thence a deflecting angle left
<br />134 045120" and running North 660.02 Feet to the point
<br />of beginning,
<br />by the Defendants, Philip D. Horak and Linda Susan Horak on the
<br />27th day of January, 1984, to the Plaintiff, and that said
<br />mortgage was duly filed for record in the office of the Register
<br />of Deeds, Hall County, Nebraska on January 30, 1984, and duly
<br />recorded as Document No. 84- 000496 of the Mortgage Records of
<br />said county thereof, and subsequently assigned to the Plaintiff.
<br />Plaintiff claims that there is now due $28,698.17 on
<br />said mortgage, plus interest'thereon at 88.92 per diem commencing
<br />October 17, 1987, and the Bond it was given to secure, and it
<br />prays for the sale of the real estate above described to satisfy
<br />the amount found due on its mortgage and interest and costs of
<br />that action.
