=T. <br />SPECIAL WARRANTY DEED <br />VICTOR M. ATCHITY, JR. and DIANNE R. ATCHITY, husband and <br />wife, herein called the Grantors, for and in consideration of the <br />release from personal liability for indebtedness owing from <br />Grantors to Grantee, do grant, bargain, sell, convey and confirm <br />unto HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, <br />herein called the Grantee, the following- described real estate in <br />Hall County, Nebraska: <br />Lot Three (3), Woodland First Subdivision to <br />the City of Grand island, Hall County, <br />Nebraska] <br />TO HAVE AND TO HOLD the premises above described, together <br />with all the tenements, hereditaments and appurtenances thereunto <br />belonging, unto the said Grantee and to Grantee's successors and <br />assigns forever. And Grantors hereby covenant with the said <br />Grantee and with Grantee's successors and assigns, that Grantors <br />are lawfully seized of said premises, that they are free from <br />encumbrance, except real estate taxes and that owing to Grantee, <br />and that Grantors have good right and lawful authority to sell <br />the same; and Grantors hereby covenant to warrant and defend the <br />title to said premises against the lawful claims of all persons <br />whomsoever. And the said Grantors hereby relinquish all right, <br />title, claim and interest in and to the above - described premises. <br />This Special Warranty Deed is given as an absolute convey- <br />ance, the Grantors having conveyed said land to the Grantee for a <br />fair and adequate consideration, such consideration being the <br />release from personal liability for obligations secured by the <br />Mortgages executed by Grantors for the benefit of Grantee, <br />recorded as Document Nos. 83- 004803 and 83- 004804 in the office <br />of the Register of Deeds of Hall County, Nebraska. <br />Grantors declare that this conveyance is freely and fairly <br />made, and it is the intention of the Grantors and the Grantee <br />that title herein to be conveyed in exchange for the release of <br />personal liability as to Deed of Trust shall not merge. <br />Signed this )1_5,64 day of 7t- , 1987. <br />i�EBRASKA DOCUMEV1ARY— cn <br />STAMP TAX <br />G 1987 Victor M.
