ATCHITY, husband and wife, herein called the Grantors, for and in consideration of the release from personal liability for indebtedness owing from Grantors to Grantee, do grant, bargain, sell, convey and confirm unto HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, herein called the Grantee, the following- described real estate in Hall County, Nebraska: Lot Three (3), Woodland First Subdivision to the City of Grand island, Hall County, Nebraska] TO HAVE AND TO HOLD the premises above described, together with all the tenements, hereditaments and appurtenances thereunto belonging, unto the said Grantee and to Grantee's successors and assigns forever. And Grantors hereby covenant with the said Grantee and with Grantee's successors and assigns, that Grantors are lawfully seized of said premises, that they are free from encumbrance, except real estate taxes and that owing to Grantee, and that Grantors have good right and lawful authority to sell the same; and Grantors hereby covenant to warrant and defend the title to said premises against the lawful claims of all persons whomsoever. And the said Grantors hereby relinquish all right, title, claim and interest in and to the above - described premises. This Special Warranty Deed is given as an absolute convey- ance, the Grantors having conveyed said land to the Grantee for a fair and adequate consideration, such consideration being the release from personal liability for obligations secured by the Mortgages executed by Grantors for the benefit of Grantee, recorded as Document Nos. 83- 004803 and 83- 004804 in the office of the Register of Deeds of Hall County, Nebraska. Grantors declare that this conveyance is freely and fairly made, and it is the intention of the Grantors and the Grantee that title herein to be conveyed in exchange for the release of personal liability as to Deed of Trust shall not merge.
