<br />DRUCIOUS YOM CO., a Nebraska corporation, herein called Grantor, in
<br />Consideration of , receipt of which is hereby
<br />acknowledged, bereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a Municipal corporation in hall County, Nebraska, heroin called Grantee, a
<br />part and perpetual easement and right -of -way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />overhead and underground public utilities, electric lines, comication lines,
<br />telephone lines, gas mains, water mains, pipe lines, cables, poles, surface
<br />markers, and all other appurtenances connected therewith, in, upon, over,
<br />above, along, across, underneath, and through an easement, sixteen (16.0) fact
<br />in width, located in part of the West Half of the East Half of the Southwest
<br />Quarter (W- 1 /2,E- 1 /2,SW -1/4) of Section Four (4), Township Eleven (11) North,
<br />Range Nine (9) West of the 6th P.M., Grand Island, Hall County, Nebraska; the
<br />Northerly and Easterly line of the easement being more particularly described
<br />as follows:
<br />#1. Comencing at the Northwest corner of said East Half of the
<br />Southwest Quarter (E- 1/2,SW -1/4);
<br />02. Thence Southerly along the West line of said East Half of
<br />to Southwest Quarter (E- 1/2,SW-1/4), a distance of one
<br />thousand two hundred eighty three and eighty -two hundredths
<br />(1,283.82) feet, to the actual point of beginning;
<br />33. Thence deflecting left 89048131" and running Easterly, a
<br />distance of two hundred eighty eight (288.0) fact;
<br />#4. Thence deflecting left 90011123" and running Northerly, a
<br />distance of two hundred forty (240.0) feet;
<br />Thence continuing Easterly from the and of Course #3, a
<br />distance of three hundred sixty nine and one - hundredth (369.01)
<br />feet, to the East line of said West Half of the East Half of
<br />the Southwest Quarter (W- 1 /2,E- 1 /2,SW -1/4);
<br />Thence Southerly along the East line of said West Half of
<br />the East Half of the Southwest Quarter (W- 1 /2,E- 1 /2,SW -1/4), a
<br />distance of forty four (44.0) feet, to the Southeast corner of
<br />a tract of land as described on Document 84- 005194, recorded in
<br />the Register of Deeds office, Hall County, Nebraska.
<br />The above described easement containing 0.346 acres, more or
<br />less as shown on the plat dated 8/21/81, marked Exhibit "A",
<br />attaches hereto, and incorporated herein by reference;
<br />together with the following rights:
<br />Unrestricted ingress and egress underneah, above, across, and through the
<br />above described easement for the purpose of exercising the rights herein
<br />granted for such public utilities and appurtenances.
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and coss,lete use, occupation, and enjoyment of the easement herein
<br />granted, including but not limited to the right to excavate and refill ditches
<br />and trenches; to remove, clear, and keep clear trees, bushes, hedges,
<br />undergrowth, and other obstructions interfering with the surveying,
<br />comet ruction* inspection, maintenance, repair, replacement, extension, removal,
<br />or operation of such utilities.
