8-7-105612 <br />RESOLUTION NO. /00 <br />Village of Doniphan, Hall County, Nebraska <br />WHEREAS, on July 12, 1944, A.M. Kellogg conveyed <br />the real estate and appurtenant struct.urvt; upon the following <br />descrihed real estate to the Vil.lag(r of Doniphan, Hall <br />County, Nebraska, to --wit: <br />The Westerly One-Third ( W113 ) orj Lot One ( 1 ) <br />in Block One (1) in the Village of Doniphan, <br />Hall County, Nebraska; <br />and <br />The Easterly Twenty -Two (E22) Feet of Lot Two <br />(2) in Block One (1) in the Village of Doniphan, <br />Hall County, Nebraska; <br />and that from said date to the present, the Village Hall <br />has rested upon the above described real estate; and <br />WHEREAS, the above description failed to include: <br />The West Ten (W10) Feet of the East Thirty -Two <br />(E32) Feet of Lot Two (2), Block One (1) in <br />the Original Town of Doniphan, Hall County, <br />Nebraska; <br />which consists of a portion of the Village Hall; and <br />WHEREAS, it was clearly the intent of A.M. Kellogg <br />to convey the entire situs of the Village Hall to the <br />Village of Doniphan; and <br />WHEREAS, the heirs of A.M. Kellogg, to -wit: Jacquelyn <br />Wehn and Hilde Kellogg, have agreed to quitclaim the West <br />Ten (W10) Feet of the East Thirty -Two (E32) Feet of Lot <br />Two (2), Block One (1) in the Original Town of Doniphan, <br />Hall County, Nebraska, to the Village to correct the defect <br />referred to above; and <br />WHEREAS, it is only fit and proper that the Village <br />indemnify Jacquelyn Wehn, her spouse and Hilde Kellogg, <br />a widow, from any liability that may arise due to taxes, <br />interest or any superior claim to the above described <br />property. <br />i <br />A <br />X <br />,,tea <br />
