87— 105552 <br />ORDINANCE NO. 7406 <br />An ordinance requiring grading, curbing, guttering, and <br />paving of Kimball Avenue from Seventh Street to Eighth Stmt; <br />providing for the levy and collection of special tares and <br />assessments upon the adjacent or abutting properties specially <br />benefited by such improvements; and providing an effective date <br />of this ordinance. <br />WHEREAS, that portion of Kimball Avenue from Seventh Street <br />to Eighth Street is unpaved and does not exceed two blocks <br />including intersections, or thirteen hundred twenty -five feet, <br />whichever is the lesser; and <br />WHEREAS, paving said portion of Kimball Avenue will make <br />Kimball Avenue one continuous paved street. <br />NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF <br />THE CITY OF GRAND ISLAND, NEBRASKA: <br />SECTION 1. Pursuant to Chapter 18, Article 20, R.R.S. <br />Nebraska 1943, that portion of Kimball Avenue from Seventh <br />Street to Eighth Street shall be improved by paving, curbing, <br />guttering, and all incidental work in connection therewith, to be <br />known as street improvement No. 1149G, in accordance with plans <br />and specifications prepared by the Engineer for the City and <br />approved by the Mayor and Council. <br />SECTION 2. The improvements shall be made at public cost, <br />but the cost thereof, excluding intersections, shall be assessed <br />upon the lots and lands in the district specially benefited <br />thereby as provided by law. <br />SECTION 3. The lots and parcels of real estate adjacent to <br />or abutting upon the portion of said street to be improved are <br />located within the following boundaries: <br />Beginning at the junction of the East line of Kimball <br />Avenue and the South line of Eighth Street, said point <br />also being the Northwest corner of Lot 4, Block 129, <br />Union Pacific Railway Co's Second Addition; thence pro- <br />ceeding in a northerly direction along an extension of <br />the East line of Kimball Avenue for a distance of 40 <br />feet] thence deflecting left in a westerly direction 40 <br />feet from and parallel to the South line of Eighth <br />Street for a distance of 80 feet; thence deflecting <br />
