7237r Schedule I <br />(Les$ehold� <br />r x.145313 <br />RIDER <br />Rider attached to and made a part of that certain Deed <br />of Trust or Mortgage dated as of the _22 day of August, <br />1987 by and between KOLN, Inc.', as "Mortgagor ", "Grantor" or <br />"Trustor ", and The First National Bank of Boston, in its <br />capacity as Collateral Trustee for the Secured Parties <br />(hereinafter defined) under the Collateral Trust Agreement <br />(hereinafter defined), in such capacity, hereinafter as <br />"Mortgagee" or "Beneficiary ". <br />With intent to be legally bound, the Mortgagor <br />(hereinafter defined) and the Mortgagee (hereinafter <br />defined) agree that the following terms and conditions are <br />herein made a part of said Mortgage or Deed of Trust as an <br />integral part thereof. The provisions of this Rider are <br />supplementary to the provisions of the Mortgage or Deed of <br />Trust to which this Rider is attached and to the extent any <br />provision of this Rider deals with the same subject matter <br />as similar .provisions of said Mortgage or Deed of Trust, the <br />provisions hereof are to be construed to expand such similar <br />provisions and not to limit the general application of any <br />general provision contained in said Mortgage or Deed of <br />Trust. In case any one or more provisions of this Rider may <br />be found to be invalid or unenforceable for any reason or in <br />any respect, such invalidity or unenforceability shall not <br />limit or impair enforcement of any other provisions of this <br />Rider. <br />S1. Representations and Warranties. The Mortgagor <br />hereby represents, covenants and warrants: <br />51.1. Title to Leasehold. Mortgagor's title to <br />the Property is free and clear of any defect in or lien <br />or encumbrance on such title except Permitted <br />Encumbrances. <br />S1.2. Authority; No Encumbrances. The Property <br />is now free and clear of all encumbrances whatsoever <br />except Permitted Encumbrances and the Mortgagor has <br />good right and lawful authority to mortgage and convey <br />the same in the manner and form hereby mortgaged and <br />conveyed. <br />S1.3. No Conflicts. The execution and delivery <br />of this Mortgage does not, and the performance and <br />observance of the terms hereof will not, contravene any <br />provision of existing law or governmental regulations, <br />and will not conflict with or result in any breach of <br />
