3879V sp &G DRAFT <br />08/13/87 <br />87-- 105311 <br />Leasehold Attachment A <br />(a) The leasehold estate created pursuant to that <br />certain Lease described in Exhibit "A" attached hereto and <br />made a part hereof with respect to the land described in <br />said Exhibit "A" (the "Premises "), and all rights of <br />Mortgagor with respect thereto, including without <br />limitation: (i) all rights of possession or use of the <br />Premises; (ii) any option or right of first refusal, whether <br />written or oral, now owned or hereafter acquired by <br />Mortgagor, to purchase or otherwise acquire the fee simple <br />title or any other estate, title or interest in or to the <br />Premises or any improvements thereon; (iii) any and all <br />deposits of cash, securities, credits or other property <br />which may be held at any time and from time to time by the <br />Lessor to secure the performance of the covenants, <br />conditions and agreements contained in the Lease; (iv) any <br />right of Mortgagor to agree to or acquiesce in any rejection <br />or termination of the Lease, whether made with respect to <br />any election under section 365(h) of the federal Bankruptcy <br />Code of 1978 (or any amended or successor provision) or <br />under any similar law or right of any nature, or otherwise; <br />and (v) all rights, privileges and prerogatives of Mortgagor <br />to terminate, cancel, modify, change, supplement, alter, <br />amend or renew the Lease; <br />(b) All and singular the Mortgagor's interest in the <br />tenements, easements, appurtenances, passages (and all <br />waters, water courses and riparian rights of Mortgagor, if <br />any), pipes, conduits, electrical and other utility lines, <br />other rights, liberties and privileges thereof or in any way <br />now or hereafter appurtaining to the Premises, including any <br />other claim at law or in equity as well as any after <br />acquired title, franchise or license and the reversion and <br />reversions and remainder and remainders thereof, and all of <br />the estate, right, title, claim or demand whatsoever of <br />Mortgagor therein and in the streets, ways and areas <br />adjacent thereto; <br />(c) All right, title and interest of Mortgagor in and <br />to any and all buildings and other improvements of every <br />kind and description leased by or belonging to the Mortgagor <br />now or hereafter erected or placed on the Premises or any <br />part thereof, and all materials intended for construction, <br />reconstruction, alteration and repairs of such improvements <br />now or hereafter erected thereon, all of which materials <br />shall be deemed to be included within the Property (as <br />a <br />R <br />
