<br />This Deed of Trust is made this 91G1- day of f, 19_82_, by and among
<br />Ernest J. Thayer and Janice M. Thayer, Husband and Wife
<br />hereinafter referred to as Trustor, whose mailing address is 404 Woodland Drive
<br />; AREND R. BAACK, Attorney at Law, hereinafter referred to as "Trustee,"
<br />whose mailing address is P. 0. Box 790, Grand Island, Nebraska 66802; and HOME FEDERAL
<br />SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "Beneficiary,"
<br />whose mailing address is 221 South Locust Street, P. 0. Box 1009, Grand Island, Nebraska
<br />68802.
<br />For valuable consideration., Trustor irrevocably grants, transfers, conveys and
<br />assigns to Trustee, in trust, with power of sale, for the benefit and security of Bene-
<br />ficiary, under and subject to the terms and conditions of this Deed of Trust, the fol-
<br />lowing described property, located in Hall County, Nebraska, to -wit:
<br />A tract of land comprising a part of Lot one (1) on Island and part of the Southeast Quarter
<br />of the Southeast Quarter (SE}.SE,l.), situated in the East Half of the Southeast Quarter (EJSEk)
<br />of Section Twenty -Eight (2B), Township Eleven (11) North, Range Nine (9), West of the 6th P.M.,
<br />in the City of Grand Island, Hall County, Nebraska, and more particularly described as follows:
<br />Beginning at a point on the West line of said East One Half of the Southeast Quarter (EJSE 41),
<br />said point being One Thousand Three Hundred Forty -Eight and Eighty -Five Hundredths (1,348.85)
<br />feet south of the northwest corner of R. W. Rasmussen Subdivision; thence easterly a distance
<br />of Eight Hundred Ninety -Seven and Fifty -Six Hundredths (897.56) feet to a point on the west
<br />line of Woodland First Subdivision, said point being Thirteen and Thirty -One Hundredths (13.31)
<br />feet north of the southwest corner of Lot Four (4), Woodland First Subdivision; thence southerly
<br />along and upon the West line of Woodland first Subdivision, a distance of Six Hundred Thirteen
<br />and Thirty -One Hundredths (613.31) feet to a point on the north line of Woodland Drive; thence
<br />westerly along and upon the north line of Woodland Drive a distance of One Hundred (100.0) feet
<br />to the northwest corner of Woodland Second Subdivision; thence southerly along and upon the
<br />westerly line of Woodland Second Subdivision, a distance of Sixty (60.0) feet to the northwest
<br />corner of Lot Seven (7), of Woodland Second Subdivision, also being a point on the south line

<br />together with all buildings, improvements, fixtures, streets, alleys, passageways,
<br />easements, rights, privileges and appurtenances located thereon or in any way pertaining
<br />thereto, and the rents, issues, profits, reversions and the remainders thereof, includ-
<br />inc all such personal property that is attached to the improvements so as to constitute
<br />a i- ixture, all of which, including replacements and additions thereto, are hereby de-
<br />clared to be a pert of the real estate conveyed in trust hereby, it being agreed that
<br />all of the foregoing shall be hereinafter referred to as the "Property."
<br />FOR THE PURPOSE OF SECURING:
<br />(a) the payment of indebtedness evidenced by Trustor's note of even date herewith
<br />in the principal sum of Two Million, Two Hundred fifty Thousand and nn/inn ------- __
<br />($2,250,000.q, together with the balance of such indebtedness, if not sooner
<br />paid, due and payable on Sept 1 , 2013; with interest at the rate or rates
<br />provided therein, along with the payment of all other sums, with interest thereon.,
<br />advanced in accordance herewith to protect the security of this Deed of Trust,
<br />together with the principal and interest on any future advance as evidenced by
<br />promissory notes stating they are secured hereby, and any and all renewals, modifi-
<br />cations and extensions of such notes, both principal and interest on the notes
<br />being payable in accordance with the terms set forth therein., which by this refer -

<br />indebtedness secured by this Deed of Trust, not including sums advanced in accord -
<br />ance herewith to protect thesecurity of the Deed of Trust, exceed the original
<br />amount of the note plus $ 00.0 ;
<br />(b) the performance of each agreement and covenant of Trustor herein contained;
<br />and
<br />(c) the payment of any sum or sums of money which may be hereafter paid or advanced
<br />by Beneficiary under the terms ofthis Deed of Trust, together with interest thereon
<br />at the rate provided in the note.
