87. 1051;2 AFFIDAVIT AS TO JOINT TENANT OWNER STATE OF NEBRASKA, COUNTY OF HALL: SS. Under other, I declare: 1. I am the widow of Gerald Hartwig who died on August 11, 1987. 2. At the time of his death, Gerald Hartwig and I, as joint tenants, owned the following described real estate located in Hall County, Nebraska: North Half of the Northeast Quarter (N 1/2 NE 1/4), and North half of South half of the Northeast Quarter (N 1/2 S 1/2 NE 1/4) of Section Four (4), Township Nine (9) North, Range Eleven (11), West of the 6th P.M., in Hall County, Nebraska, being approximately 120 acres, more or less. 3. All of the property, both real estate and personal property in which my husband, Gerald Hartwig, had an interest, at his death, was owned by him and me as joint tenants and not as tenants in common. 4. The total fair market value of all of the joint tenancy property owned by Gerald Hartwig and me, as joint tenants, at the time of death of Gerald Hartwig, was less than the sum of $600,000.00, and no Form 706 (United States Estate Tax Return) has been or will be filed with the Internal Revenue Service because no United States Estate Tax can be or was assessed as a result of the death of Gerald Hartwig. 5. Since all of the property owned by Gerald Hartwig was owned by him with me as joint tenants and not as tenants in common, Gerald Hartwig had no liability for a Nebraska Estate Tax nor is there any liability because of his death for any Nebraska Inheritance Tax. 6. I am the sole owner of all of the real estate and personal property owned by Gerald Hartwig and me, as joint tenants, at the time of his death, by virtue of being the surviving joint tenant, and the property passing to me is exempt from United States Estate Tax, Nebraska Estate Tax and Nebraska Inheritance Tax.
