PUBLIC UTILITY BASEMENT 87-- 1 a,50,99 <br />HALL COUNTY LIVESTOCK IMPROVEMENT ASSOCIATION, a Nebraska <br />Corporation, Grantor, in consideration of certain mutual promises <br />pertaining to the construction of a drive from Fonner Park to s <br />Locust Street, does hereby grant and convey unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation, Grantee, a permanent and perpetual <br />easement and right -of -way to construct, operate, maintain, <br />extend, repair, replace and remove a storm sewer, inlet, manhole <br />and other appurtenances, upon, over, in, and through the <br />following described real estate: <br />A tract of land in the NW1 /4 SW1 /4, Section 22, <br />Township 11 North, Range 9 West of the 6th P.M., Hall <br />County, Nebraska more particularly described as follows: <br />Beginning at a point on the east right -of -way line of <br />Locust Street, said point being 40.0 feet east of the west <br />line of said Section 22 and 231.75 feet south of the south <br />line of Janisch Subdivision; thence east parallel to the <br />north line of the NW1 /4 SW1 /4 of said Section 22, a distance <br />of 4.5 feet; thence south parallel to the east right -of -way <br />line of Locust Street a distance of 6.0 feet; thence west a <br />distance of 4.5 feet; thence north on the east right -of -way <br />line of Locust Street a distance of 6.0 feet to the point of <br />beginning, containing 27.0 square feet, more or less. <br />Together with rights of unrestricted ingress and egress <br />upon, over, in, and through the above described real estate for <br />the purpose of excercising the rights granted herein, to clear <br />and keep clear of trees, roots, and brush from the surface of <br />said tract. Any improvements or appurtenances placed upon, over, <br />in and through the above described real estate shall remain the <br />property of the Grantee and may be removed or replaced at any <br />time. <br />Any sidewalk, driveway or street damaged or removed by the <br />Grantee in the exercise of the rights granted by this public <br />utility easement shall be replaced by the Grantee at its expense. <br />The Grantor, for itself, its successors and assigns hereby <br />covenants that no improvements or appurtenances shall be erected <br />or permitted upon the above described real estate and that the <br />public utility easement granted herein shall run with the title <br />to the above described real estate and shall be binding upon the <br />Grantor, its successors and assigns. A plat showing the location <br />of the above described real estate subject to this public utility <br />easement is attached hereto as Exhibit A and made a part hereof <br />by reference. <br />in <br />
