87--- 10504 <br />THELMk E. =, a single parson, GRANTOR, in consideration of <br />ombanga of property and other good and valuable consideration, received from <br />GRANTEE, JANICE, M. THAYER, conveys to GRANTEE, the following -described real <br />estate (as defined in Nebraska Revised Statute 76 -201): <br />A tract of land comprising a part of Lot One (1) on Island and part of the <br />Southeast Quarter of the Southeast quarter (S), situated in the East Half <br />Of the Southeast Quarter (A SEtq) of Section Twenty -Eight (28), Tomship <br />Eleven (11) North, Range Nine (9), West of the 6th P.M., in the City of Grand <br />Island, Hall County, Nebraska, and mere particularly described as follows: <br />Beginning at a point on the West line of said East one -Half of the <br />Southeast Quarter (Eh SE%), said point being one Thousand 'Three <br />Hundred Fbrty -Eight and Eighty -Five Hundredths (1,348.85) fe --t south <br />of the northwest corner of R. W. Rasmussen Subdivision; thence <br />easterly a distance of Eight Hundred Ninety -Seven and Fifty -Six <br />Hundredths (897.56) feet to a point on the west line of Woodland <br />First Subdivision, said point being Thirteen and Thirty -One <br />Hundredths (13.31) feet north of the southwest corner of Lot Four <br />(4), Woodland First Subdivision; theme southerly along and upon the <br />west line of Woodland First Subdivision, a distance of Six Hundred <br />Thirteen and Thirty -one Hundredths (613.31) feet to a point on the <br />north line of Woodland Drive; thence westerly along and upon the <br />north line of Woodland Drive a distance of One Hundred (100.0) feet <br />to the northwest corner of Woodland Second Subdivision; thence <br />southerly along and upon the westerly line of Woodland Second <br />Subdivision, a distance of Sixty (60.0) feo°t to the northwest corner <br />of Lot Seven (7) of Woodland Second Subdivision, also being a point <br />on the south line of Woodland Drive; thence westerly along and upon <br />the prolongation of the south line of Woodland Drive, a distance of <br />Seven Hundred Ninety -Seven and Sixty -Nine Hundredths (797.69) feet <br />to a point on the west line of said East one Half of the Southeast <br />Quarter A SE%) ; thence northerly along and upon the west line of <br />said East One Half of the Southeast Quarter (Eh SE%), a distance of <br />Six Hundred Seventy- Rtnree and Thirty -One Hundredths (673.31) feet to <br />the point of beginning and containing 13.737 acres, more or less. <br />Subject to easements and restrictions of record and an easement for <br />ingress and egress over the Easterly Sixty (60) Feet of the Southerly Sixty <br />(60) Feet of the land conveyed hereby reserved to GRANTOR, her heirs and <br />assigns, for access to Woodland Drive from real property owned by GRANTOR <br />immediately adjoining on the Southerly boundary the property sold hereby. <br />Further subject to the following: rights, if any, of the United States <br />Of America, State of Nebraska, and the public generally in and to any portion <br />of such property which may lie below the mean high water mark of any river on <br />said property; and rights, if any, of property owners abutting any such river <br />on said property in and to the waters of any such river on said property and <br />in and to the bed thereof; and the rights, if any, of others in and to the use <br />of any drains and/or ditches located over, across, in or under the property <br />and rights to enter upon said property to maintain the same. <br />GRANTOR covenants with GRANTEE that GRANTOR: <br />(1) Is lawfully seized of such real estate and that it is free from <br />encumbrances; <br />(2) Has legal power and lawful authority to convey the same; and <br />(3) Warrants and will defend title to the real estate against the <br />lawful claims of all persons. <br />Emecuted August 21, 1987. <br />THELMA E.
