104991 <br />Together with all and singular the tenements, hereditaments, privileges and appurt now or hereafter <br />located upon or belonging to or in anywise appertaining to the above described property, or any part thereof, <br />including any right of homestead and every Contingent right or estate therein. <br />To time and to Hold the Sanhe, together with all and singular the privileges and appurtenances thereunto <br />belonging: In Trust Nevertheless, that in case of default in the payment of said Nate or any part thereof, or in <br />the payment of the interest thereon, according to the tenor and effect of said Note, principal or interest, if any, <br />or in cep default shall be made in or in case of violation or breach of any of the terms, conditions, covenants, <br />or agreernerft herein contained, then all sum secured hereby shall immediately become due and payable at <br />the option of the holder of the Note, and the Trustee may proceed to sell the property in accordance with the <br />Nebraska Trust heeds Act (Section 76-1001 et. seq.). Trustee shall receive a fee of One Percent (1 %) of the <br />entire Indebtedness then owing to Beneficiary as a fee in exercising the power of sale. <br />And the Trustor covenants and agrees to and with the Trustee, that at the time of the ensealing of and delivery <br />of #me presents. he is weN seized of the said premises in fee simple and has good right, full power, and lawful <br />auftnty to grant, bargain, set and convey the same in manner and form as aforesaid; and that the same are <br />free and clew of all hem and encumbrances whatever and the herein bargained premises in the quiet and <br />peaceable possession of the Trustee against ell and every perm or persons lawfully claiming or to claim the <br />whole or any part thereof, Truster shall and will warrant and forever defend. <br />Arid the Thuor will pal- all taxes and assessments on said premises immediately when they become due and <br />payWe; and as the nKlueet of the legal Folder of said Note will keep all buildings that may at any time be on <br />said premises, during the oWaxiance of said Indebtedness. insured against loss by fire in such company or <br />cornpanies and for such amounts as the homer of said Note may from time to time direct, not to exceed the <br />WOW of ' exert at the option of Trusw, with loss, if any, payable to the Benefloiary her- <br />ounder as Its Interest may appear. and wiN deliver the policy or policies of Insurance, accompanied by premium <br />receipts to the Beneficiary herauncW, as further security for the ' Indebtedness aforesaid. And in case of the re- <br />hisal neglect of Ttuslor to thus insure and deliver such policies of insurance or to pay such taxes or assess - <br />then the holdier of said N&A may procure such prance, or pay such taxes or assessments, and all <br />with Interest thereon at 18 percent per annum, shall become so much additional <br />w4eb"wiles, secured by this Deed of ThM. and shall be paid out of the proceeds of the sale of the lands and <br />premim ` , if not by sod Trustor. <br />
