<br />SPECIAL WARRANTY DEED
<br />KNOW ALL MEN BY THESE PRESENTS: THAT we, DANIEL L. JOURNEY AND NANCY M. JOURNEY,
<br />husband and wife, of the county of Hall, State of Nebraska, have agreed to give up and
<br />surrandor the lands hereinafter described in lieu of a foreclosure, as security for
<br />the amount of money remaining unpaid an said mortgage, do hereby sell and convey unto
<br />FIRST FEDERAL SAYINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation,
<br />its successors and assigns, for and consideration of the sum of One and No /100 Dollar
<br />($1.00), and other valuable' consideration, the following described premises, to -wit:
<br />The Northerly Sixty -eight (N68) feet of Lot One (1), Block
<br />Twelve (12), in Gilbert's Second Addition to the City of
<br />Grand Island, Hall County, Nebraska,
<br />together with all appurtenances thereunto be'',- aging, free And c ?ear of all
<br />encumbrances except a first mortgage in favor of First Federal Savings and Loan
<br />Association of Lincoln, Lincoln, Nebraska, in the principal sum of Twenty -eight
<br />Thousand Three Hundred Fifty and No /100 Dollars ($28,350.00), dated March 31, 1979 and
<br />filed for record April 2, 1979 in Document No. 79- 001782, of the Mortgage Records of
<br />Hail County, Nebraska, and a mortgage in the principal sum of Ten Thousand Eight
<br />Hundred and No /100 Dollars ($10,800.00), dated September 2, 1983 and filed for record
<br />September 2, 1983 in Document No. 83- 004698 of the Mortgage Records of Hall County,
<br />Nebraska, and easements and restrictions of record, and do covenant to warrant and
<br />defend the said premises against any act of said grantors or any other person claiming
<br />through or under it. The grantee hereby releases and discharges any and all liens and
<br />claims under and by virtue of the mortgage aforesaid for a deficiency judgment:. The
<br />grantors further covenant that this conveyance is and does constitute an absolute
<br />conveyance of title to the premises to the grantee herein in effect as well as form,
<br />and is not intended as a mortgage, trust conveyance or as security of any kind and
<br />that possession of the premises is delivered concurrently herewith. And the said
<br />grantors hereby relinquish all right, title, interest and all equity of redemption in
<br />and to the above described premises.
