ESTOPPEL AFFIDAVIT <br />STATE OF NEBRASKA <br />as. <br />COUNTY OF HALL <br />87-104739 <br />Ronda R. Roby, being first duly sworn, deposes and says <br />that she is the wife of Kenneth H. Roby and that said Kenneth <br />H. Roby and Affiant are the identical parties who made, executed <br />and delivered that certain Deed to Iogise D. and Std F. Fleharty wife <br />and husband; Wrle G. and Kenneth E. Robertson, wife and husband; Edvtbe I and <br />conveying the ollowing- described property, to -wit: <br />Lot Eight (8), Block Sixteen (16) in Schimmer's <br />Addition to the City of Grand Island, Hall <br />County, Nebraska. <br />That said Kenneth H. Roby and Affiant now are, and at all <br />time herein mentioned, were husband and wife; <br />That the aforesaid Deed was intended to be and was an abso- <br />lute conveyance of the title to said premises to the Grantees <br />named therein, and was not and is not now intended as a mortgage, <br />trust conveyance or security of any kind; that it was the inten- <br />tion of Affiant and her husband, as Grantors, in said Deed to <br />convey, and by said Deed they did convey to the Grantees therein <br />all their right, title and interest absolutely in and to said <br />premises; that possession of said premises has been surrendered <br />to the Grantees; <br />That in the execution and delivery of said Deed Affiant and <br />her husband were not acting under any misapprehension as to the <br />effect thereof and acted freely and voluntarily and were not <br />acting under coercion or duress; <br />That the aforesaid Deed was not given as a preference against <br />any other creditor of Affiant or her husband; that at the time <br />it was given there was no other person or persons, firms or <br />corporations, other than the Grantees therein named interested, <br />either directly or indirectly in said premises; that Affiant and <br />her husband are solvent and have no other creditors whose rights <br />would be prejudiced by such conveyance, and that Affiant and her <br />husband are not obligated upon any bond or other mortgage whereby <br />any lien has been created or exists against the premises described <br />in said Deed. <br />That the consideration for said Deed was and is full cancel- <br />lation of all debts, obligations, costs and charges secured by <br />that certain mortgage heretofore existing on said property <br />executed by Kenneth H. Roby and Ronda R. Roby, husband and wife, <br />mortgagors, to John C. Krabel, a single person, as mortgagee, <br />dated the 30th day of April, 1982, and recorded as Document <br />No. rA -QD 1'7.z'Z in the Office of the Register of Deeds of <br />Hall County, Nebraska, and the cancellation of record by the <br />assignees of said mortgagee and that at the time of making said <br />Deed, Affiant believed and now believes that the aforesaid con- <br />sideration therefore represents the fair value of the property <br />so deeded; <br />This Affidavit is made for the protection and benefit of <br />the Grantees in said Deed, their successors and assigns, and <br />all other parties hereafter dealing with or who may acquire <br />an interest in the property herein described. <br />That Affiant will testify, declare, depose or certify before <br />any competent tribunal, officer or person, in any case now pend- <br />ing or which may hereafter be instituted, to the truth of the <br />particular facts hareinabove set forth. <br />Ron R.
