ESTOPPEL AFFIDAVIT STATE OF NEBRASKA as. COUNTY OF HALL 87-104739 Ronda R. Roby, being first duly sworn, deposes and says that she is the wife of Kenneth H. Roby and that said Kenneth H. Roby and Affiant are the identical parties who made, executed and delivered that certain Deed to Iogise D. and Std F. Fleharty wife and husband; Wrle G. and Kenneth E. Robertson, wife and husband; Edvtbe I and conveying the ollowing- described property, to -wit: Lot Eight (8), Block Sixteen (16) in Schimmer's Addition to the City of Grand Island, Hall County, Nebraska. That said Kenneth H. Roby and Affiant now are, and at all time herein mentioned, were husband and wife; That the aforesaid Deed was intended to be and was an abso- lute conveyance of the title to said premises to the Grantees named therein, and was not and is not now intended as a mortgage, trust conveyance or security of any kind; that it was the inten- tion of Affiant and her husband, as Grantors, in said Deed to convey, and by said Deed they did convey to the Grantees therein all their right, title and interest absolutely in and to said premises; that possession of said premises has been surrendered to the Grantees; That in the execution and delivery of said Deed Affiant and her husband were not acting under any misapprehension as to the effect thereof and acted freely and voluntarily and were not acting under coercion or duress; That the aforesaid Deed was not given as a preference against any other creditor of Affiant or her husband; that at the time it was given there was no other person or persons, firms or corporations, other than the Grantees therein named interested, either directly or indirectly in said premises; that Affiant and her husband are solvent and have no other creditors whose rights would be prejudiced by such conveyance, and that Affiant and her husband are not obligated upon any bond or other mortgage whereby any lien has been created or exists against the premises described in said Deed. That the consideration for said Deed was and is full cancel- lation of all debts, obligations, costs and charges secured by that certain mortgage heretofore existing on said property executed by Kenneth H. Roby and Ronda R. Roby, husband and wife, mortgagors, to John C. Krabel, a single person, as mortgagee, dated the 30th day of April, 1982, and recorded as Document No. rA -QD 1'7.z'Z in the Office of the Register of Deeds of Hall County, Nebraska, and the cancellation of record by the assignees of said mortgagee and that at the time of making said Deed, Affiant believed and now believes that the aforesaid con- sideration therefore represents the fair value of the property so deeded; This Affidavit is made for the protection and benefit of the Grantees in said Deed, their successors and assigns, and all other parties hereafter dealing with or who may acquire an interest in the property herein described. That Affiant will testify, declare, depose or certify before any competent tribunal, officer or person, in any case now pend- ing or which may hereafter be instituted, to the truth of the particular facts hareinabove set forth.
