10 <br />7. 104'753 <br />the Subdivider hereby consents and agrees with the City of Grand <br />Island, Nebraska, it it will install or provide at its expense <br />the following improvements: <br />1. Commercial Development. The proposed subdivision <br />constitutes a planned unit development, pursuant to Section 36 -25 <br />of the Grand Island City Code. For that reason, the Subdivider <br />agrees that the continuing requirements of Section 36 -25 of the <br />Gram Island City Code pertaining to commercial development under <br />the Planned Unit Development will be complied with by the Sub- <br />divider. <br />2. Flood Hazard. Since the subdivision is in the flood <br />plain, all structures constructed shall have the lowest floor <br />elevation to a minimum of one foot above the elevation of the one <br />hundred year flood, as determined by the building permit received <br />by the Subdivider or successors from the Building Department <br />under the provisions of Section 2- 1506.06, R.R.S. 1943. No base - <br />ment shall be constructed in connection with any structure in the <br />flood plain unless such basement is floodproofed and certified as <br />such by a qualified registered engineer or architect. <br />3. Water. The Subdivider agrees to connect all structures <br />in the subdivision to the public water main which is available. <br />4. Sanitary Sewer. The Subdivider agrees to connect all <br />structures in the subdivision to the public sanitary sewer system <br />which is available. <br />5. Drainage. The Subdivider agrees to grade the lots of <br />the subdivision so that the majority of the storm water drains to <br />the drainage system within the Grand Island Mall Subdivision and <br />in a manner approved by the City's Director of Public Works. <br />2 <br />A <br />01 <br />
