agnm <br />(b) Trustor, upon obtaining knowledge of the institution of <br />any proceedings for the condemnation of the Premises and Improve- <br />ments or any portion thereof or knowledge of any casualty damage <br />to the Property or damage of any other kind, will immediately <br />notify Beneficiary. Beneficiary may participate in any proceed - <br />ings and join Trustor in adjusting any loss covered by <br />insurance. All compensation, awards, proceeds, damages, claims, <br />rights of action and payments to which Trustor may become <br />entitled shall be paid over to Beneficiary. Beneficiary shall <br />have the sole and absolute discretion, notwithstanding the fact <br />that the security given hereby may not be impaired by a partial <br />condemnation to apply any part or all of the amount collected in <br />connection with any condemnation proceeding: (i) upon any <br />indebtedness secured hereby and in such order as Beneficiary may <br />determine, or (ii) without reducing the indebtedness secured <br />hereby, to the reimbursement of Beneficiary for expenses incurred <br />by it in the restoration of the Property. Such application shall <br />not cure or waive any default or notice of default hereunder or <br />invalidate any act done pursuant to such notice. Beneficiary <br />shall be under no obligation to question the amount of any com- <br />pensation, awards, proceeds, damages, claims, rights of action or <br />payments, and may accept the same in the amount in which the same <br />shall be paid. <br />
