<br />This Deed of Trust is made this day of . .0 ,
<br />1987, by and among COUNTRYSIDE ACRES, INC., herein ter erred
<br />to as " Trustor," whose mailing address is 1419 West Stagecoach
<br />Road, Grand Island, Nebraska 68801; AREND R. BAACK, Attorney at
<br />Law, hereinafter referred to as "Trustee," whose mailing address
<br />is P. O. Box 790, Grand Island, Nebraska 68802; and THE OVERLAND
<br />NATIONAL BANK OF GRAND ISLAND, hereinafter referred to as "Benefi-
<br />ciary," whose mailing address is P. 0. Box 1688, Grand Island,
<br />Nebraska 68802.
<br />For valuable consideration, Trustor irrevocably grants,
<br />transfers, conveys and assigns to Trustee, in trust, with power
<br />of sale, for the benefit and security of Beneficiary, under and
<br />subject to the terms and conditions of this Deed of Trust, the
<br />following- described property, located in Hall County, Nebraska,
<br />to -wit:
<br />The North One Hundred Sixty -Five (165) Feet
<br />of the North Half of the Southwest Quarter of
<br />the Northwest Quarter (N }SW }NW}) of Section
<br />Nine (9), Township Twelve (12) North, Range
<br />Nine (9) West of the 6th P.M., in Hall
<br />County, Nebraska, excepting that part thereof
<br />heretofore conveyed for highway purposes; and
<br />The North Half of the Southwest Quarter of
<br />the Northwest Quarter (N}SWJNW}) of Section
<br />Nine (9), Township Twelve (12) North, Range
<br />Nine (9) West of the 6th P.M., Hall County,
<br />Nebraska, excepting the North One Hundred
<br />Sixty -Five (165) Feet of the North Half of
<br />the Southwest Quarter of the Northwest
<br />Quarter (N }SW }NW}) of Section Nine (9),
<br />Township Twelve (12) North, Range Nine (9)
<br />West of the 6th P.M., excepting that part
<br />thereof heretofore conveyed for highway
<br />purposes;
<br />together with all buildings, improvements, fixtures, streets,
<br />alleys, passageways, easements, rights, privileges and appurte-
<br />nances located thereon or in any way pertaining thereto, and the
<br />rents, issues, profits, reversions and the remainders thereof,
<br />including all such personal property that is attached to the
<br />improvements so as to constitute a fixture, all of which, includ-
<br />ing replacements and additions thereto, are hereby declared to be
<br />a part of the real estate conveyed in trust hereby, it being
<br />agreed that all of the foregoing shall be hereinafter referred to
<br />as the "Property."
<br />FOR THE PURPOSE OF SECURING:
<br />(a) the payment of personal indebtedness owing
<br />from Trustor to Beneficiary, as evidenced by Promissory
<br />Notes of various dates described as follows:
<br />(i) a Floating Rate Promissory Note
<br />dated December 15, 1986, in the original
<br />principal amount of Sixty -One Thousand Seven
<br />Hundred Sixty and 19/100 Dollars
<br />($61,760.19);
<br />(ii) a Floating Rate Promissory Note
<br />dated December 15, 1986, in the original
<br />principal amount of Twelve Thousand and
<br />No 1100 Dollars ($12,000.00); and
