M <br />�- 87-- 104361 <br />ACKNOWLEDGEMENT <br />The undersigned, COUNTRYSIDE ACRES, INC., identified as <br />"Trustor" under a certain Deed of Trust dated to <br />be entered into among Trustor; Arend R. Baack, Trustee; and The <br />Overland National Bank of Grand Island, Beneficiary, hereby <br />acknowledges that this Acknowledgement is made prior to its <br />execution of that Deed of Trust in respect to that real estate <br />described as: <br />The North One Hundred Sixty -Five (165) Feet <br />of the North Half of the Southwest Quarter of <br />the Northwest Quarter (N }SW }NW}) of Section <br />Nine (9), Township Twelve (12) North, Range <br />Nine (9) West of the 6th P.M., in Hall <br />County, Nebraska, excepting that part thereof <br />heretofore conveyed for highway purposes; and <br />The North Half of the Southwest Quarter of <br />the Northwest Quarter (N}SWJNW}) of Section <br />Nine (9), Township Twelve (12) North, Range <br />Nine (9) West of the 6th P.M., Hall County, <br />Nebraska, excepting the North One Hundred <br />Sixty -Five (165) Feet of the North Half of <br />the Southwest Quarter of the Northwest <br />Quarter (N }SW }NW}) of Section Nine (9), <br />Township Twelve (12) North, Range Nine (9) <br />West of the 6th P.M., excepting that part <br />thereof heretofore conveyed for highway <br />purposes; <br />and that it knows and understands that (a) the Deed of Trust to <br />be executed by Trustor is a Trust Deed and not a Mortgage; and <br />(b) that the power of sale provided for in the Deed of Trust <br />provides essentially different rights and obligations to the <br />Trustor than a Mortgage in the event of default or breach of <br />obligation. <br />-1- <br />In <br />X <br />J <br />
