87-- 194195 SPECIAL WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS: THAT we, VICTOR GENE HESMAN AND JEANETTE MARIE HESMAN, husband and wife, of the county of Hall, State of Nebraska, have agreed to give up and surrender the lands hereinafter described in lieu of a foreclosure, as security for the amount of money remaining unpaid on said mortgage, do hereby sell and convey unto FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation, its successors and assigns, for and in consideration of the sum of One and No /100 Dollar ($1.00), and other valuable consideration, the following described premises, to -wit: Lot Thirty -six (36), Block "D ", in Park -View Subdivision, located in the Northeast Quarter (NE1 /4) of Section 29, and the Northwest Quarter (NW1 /4) of Section 28, all in Township 11 North, Range 9 West of the 6th P.M., Hall County, Nebraska. together with all appurtenances thereunto belonging, free and clear of all encumbrances except a first mortgage in favor of First Federal Savings and Loan Association of Lincoln, Lincoln, Nebraska, in the principal sum of Thirty -six Thousand and No /100 Dollars ($36,000.00), dated August 24; 1979 and filed for record August 24, 1979, in Document No. 79- 005502, of the Mortgage Records of Hall County, Nebraska, and easements and restrictions of record, and do covenant to warrant and defend the said premises against any act of said grantors or any other person claiming through or under it. The grantee hereby releases and discharges any and all liens and claims under and by virtue of the mortgage aforesaid for a deficiency judgment. The grantors further covenant that this conveyance is and does constitute an absolute conveyance of title to the premises to the grantee herein in effect as well as form, and is not intended as a mortgage, trust conveyance, or as security of any kind and that possession of the premises is delivered concurrently herewith. And the said grantors hereby relinquish all right, title, interest and all equity of redemption in and to the above described premises.
