<br />TRUSTEE'S DEED 87--104018
<br />KNOW ALL MEN BY THESE PRESENT: That JOSEPH 11. BADAMI, Trustee, upon a Dead of Trust
<br />made and entered into on or about May 1, 1984, by and between Steven M. Mason and
<br />Cynthia J. Mason, Trustors, and Joseph H. Badami, Trustee and First Federal Savings
<br />and Loan Association.of Lincoln, Beneficiary, of the Register of Deeds office of Hall
<br />County, Nebraska, herein called the GRANTOR, in consideration of Seventeen Thousand
<br />Six Hundred Fifty and No /100 Dollars ($17,650.00), and other valuable consideration
<br />received from Grantee, does hereby grant, bargain, sell, convey and confirm unto FIRST
<br />FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation, herein
<br />called the GRANTEE, the following described real estate in Hall County, Nebraska:
<br />Lot Twenty (20), Block Twenty -five (25), College Addition
<br />to West Lawn, an Addition to the City of Grand Island,
<br />Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above - described premises together with all
<br />tenements, hereditaments and apppurtenances thereto belonging unto the Grantee, and to
<br />Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with the Grantee and with the Grantee's
<br />successors and assigns:
<br />(1) That Steven M. Mason and Cynthia J. Mason, Trustors, failed to pay the
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of
<br />the Beneficiary, elected to declare the entire unpaid principal balance, together with
<br />interest thereon, at once immediately due and payable.
<br />(2) That a Notice of Default was filed by Grantor on March 12, 1987, in
<br />7ocument No. 87- 101318 of the Miscellaneous Records in the Register of Deeds office of
<br />Hall County, Nebraska. A copy of Lite Notice of Default was served upon Steven M.
<br />Mason and Cynthia J. Mason by certified mail, postage prepaid, on March 16, 1987.
<br />(3) That Trustors, Steven M. Mason and Cynthia J. Mason, failed to cure the
<br />default referenced in the Notice of Default within 30 days after the service of the
<br />Notice of Default.
<br />(4) That a Notice of Trustee's Sale was filed and a copy of the Notice of
<br />Trustee's Sale was served upon Steven M. Mason and Cynthia J. Mason, by certified
<br />mail, postage prepaid on May 1, 1987.
<br />(5) Grantor published Notice of Trustee's Sale, to be held on Wednesday,
<br />the 11th day of June, 1987, at 10 o'clock a.m., at Grand Island, Hall County,
<br />Nebraska, which Notice was published in Grand Island Independent, Hall County,
<br />Nebraska, once a week for five (5) consecutive weeks, commencing on April 29, 1987,
<br />and ending on May 27, 1987. The last publication on Notice was at least ten (10) days
<br />prior to the Trustee's Sale, and said sale was not later than thirty (30) days after
<br />the last publication of Notice.
<br />(6) Grantor conducted the sale of the real property at public auction and
<br />has accepted the bid of First Federal Savings and Loan Association of Lincoln in the
<br />suet of Seventeen Thousand Six Hundred Fifty and No /100 Dollars ($1.7,650.00), as the
<br />highest bid upon said real property. Grantor has complied with the requirements of
<br />the above - referenced Deed of Trust and the requirements of Nebraska Statutes, §76 -1001
<br />through 576 -1018, 1965, in the exercise of the sale of the real property described
<br />herein at the Trustee's Sale held on June 17, 1987.
<br />This Deed shall operate to convey to the Grantee, without right of
<br />redemption, the Grantor's title and all right, title, interest and claim of the
<br />Truator, and their successors in interest and of all persons claiming by, through or
<br />under it, in and to the above - described real property, including all such right,
<br />title, interest and claim in interest subsequent to the execution of the Deed of
<br />Trust.
<br />This Deed is subject to all easements, restrictions or covenants of record,
<br />which Grantor is not entitled to convey pursuant to Nebraska Statute, §76- 1010(2),
<br />R.R.S., 1965.
