LIS PENDENS 87-- 103353 Notice is hereby given that a Petition has been filed in the District Court of Hall County, Nebraska, wherein Commercial Federal Savings and Loan Association, a corporation, is plaintiff and Mark A. Nightser, et al, are the defendants, the object and prayer of which is to obtain an accounting from said defendants of the amount due plaintiff on the mortgage dated the 12th day of September, 1980, and filed in the office of the Register of Deeds, Hall County, Nebraska, on the 15th day of September, 1980, as Document No. 80- 005042, wherein Mark A. Nightser and Mary Ann Nightser, husband and wife, mortgaged and conveyed to plaintiff the following described real estate situated in Hall County, Nebraska, to -wit: Lot Fifteen (15), in Villa Mar Dee Subdivision, a Subdivision located on all of Lot Twelve (12) of Subdivision of Lot Nine (9) and all of Lots Seven (7) and Eight (8) in Windolph's Subdivision of part of the NE 1/4 NW 1/4 and part of the NW 1 /4 -NE 1/4 of Section Fourteen, in Township Eleven North, Range Nine, West of the Sixth P. M., in Hail County, Nebraska; to obtain a foreclosure of said mortgage and to have the same declared a lien upon the interest of Mark A. Nightser, et al, in said real estate and appurtenances thereto; to have said real estate and appurtenances sold to satisfy the amount so found due, together with the cost of suit and to foreclose the said defendants of all right, title, interest, lien, claim, demand and equity of redemption whatever in and to the said real estate and appurtenances thereto, together with such other and further relief as to the Court may seem just and equitable.
