Walter and Ralph Walter of Billings, Montana ( "Grantor ") hereby transfers, assigns and conveys to Walter Sarpy Creek Farm, Inc., a Montana corporation with offices . at 1135 Clark Avenue, Billings, Montana 59102 ( "Grantee ") and to the successors, transferees and assigns forever of the Grantee all of the interest owned or deemed owned by Grantor in all minerals or other substances which now are or hereafter may become valuable (that is valuable in themselves aside from their location within the earth) of every kind and nature except sand and gravel in, on or under the surface of the following property in Hall County, Nebraska: Township 9 North, Range 9 West, 6 P.M. Section 25: E� By the recording of this mineral deed the Grantee accepts the ownership of the minerals and other substances subject to the responsibility to respond to and compensate the then surface owner for any damages to the surface of the property or suffered by said surface owner as the result of exploring for, extracting, mining, producing or otherwise removing any minerals or other substances from or under the property including, but not limited to, damages for construction of roads and pipelines to transport materials, equipment and minerals. This mineral deed is made without warranty, express or implied, but includes the right to enter upon the property to explore for, mine, extract or otherwise remove any of such minerals or other substances by any method, even though such method employed may result in damage to or destruction of the surface of the property.
