<br />w ether one or more, hereinafter. called 'Trustor' whose mailing
<br />address is Route 1. Box 66. A1da, Nebraska 68801
<br />_BANK OF WOOD RIVER, Wood River, Nebraska 68883 as "Trustee ",
<br />and BANK OF WOOD RIVER, Wood River, Nebraska 68883 as
<br />Beneficiary.
<br />WITNESSETH: That Trustor, in consideration of $34,000.00
<br />and other valuable consideration receipt whereof is
<br />hereby acknowledged, grants, conveys, sells and warrants to Trustee,
<br />in trust, with power of sale, the following described property,
<br />situated in uaii County, Nebraska:
<br />The North Half of the Northwest Quarter (NhNW4) of
<br />Section Thirty (30), Township Ten (10) North, Range
<br />Ten (10), West of the 6th P.M., Hall County, Nebraska,
<br />together with all of the right, title and interest of
<br />the Trustor in said property and including all build -
<br />ings and improvements now on or hereafter placed upon
<br />said real property; including all wells, pumps, motors,
<br />and equipment located on and used to irrigate said
<br />premises and any additions to or replacements thereof,
<br />which items are declared to be part of the premises and
<br />appurtenant to said real estate.
<br />The intention being to convey hereby an absolute title in fee simple,
<br />including all the rights of homestead, together with all buildings,
<br />fixtures, improvements and appurtenances thereunto belonging; and
<br />all of the foregoing, together with said property are herein refer -
<br />red to as the "Property ".
<br />FOR THE PURPOSE OF SECURING performance of each agreement
<br />and covenant of Trustor herein contained and the pa ment of the
<br />principal sum of THIRTY -FOUR THOUSAND DOLLARS ($34,000.00)
<br />as evidenced by a promissory note bearing
<br />even date at the rates of interest thereon which may hereafter be
<br />paid or advanced under the terms of this Trust Deed; both princi-
<br />pal sum and interest thereon being payable according to the terms
<br />set forth in said promissory note, reference to which is hereby
<br />made, at the Bank of the Beneficiary in Wood River ,
<br />Nebraska, or at such of er place as the holder may designate in
<br />writing, the final payment of principal and interest, if riot sooner
<br />paid, shall be due and payable on the 1st day of Mav ,
<br />1997 . Trustor has right to prepay any principal wit ouh t penalty
<br />as to interest.
<br />Trustor and Beneficiary covenant and agree as follows:
<br />1. Warranty of Title. Trustor is lawfully seized of the Property;
<br />it has good right �and lawful authority to sell and convey the Pro -
<br />perty; the Property is free and clear of all liens and encumbrances
<br />except liens now of record; and Trustor will warrant and defend
<br />the title to the Property unto the Trustee and its successors and
<br />assigns forever, against the claims of all persons. Trustor, at
<br />its expensd, will maintain and preserve the lien of this Trust beed
