Paul McIntosh and Eleanor McIntosh, Husband and Wife, <br />hereafter McIntosh, and Leo Mettenbrink and Jeanne . <br />Mettenbrink Husband and Wife, hereafter Mettenbrink, in consideration <br />of the mutual granting of easements to each other hereby grant the <br />easements as hereafter set out. <br />Whereas McIntosh, is the owner of certain property in the <br />Southeast Quarter of Section 10, Township 12 North, Range 10 West of <br />the 6th P.M., described on attached Exhibit A, and Mettenbrink, is the <br />owner of the balance of the property in said Southeast Quarter of <br />Section 10. <br />NOW THEREFORE THE PARTIES HERETO EACH GRANT TO THE OTHER <br />EASEMENTS AS FOLLOWS: <br />McIntosh grants to Mettenbrink an easement to enter upon or cross <br />"Parcel C" described below as may be necessary to carry out farming <br />operations on that portion of said Southeast 1/4, of Section 10 owned <br />by Mettenbrink on the date hereof. <br />PARCEL C <br />A part of the Southeast Quarter of Section 10, Township 12 <br />North, Range 10 West of the 6th r.M. in Hall County <br />Nebraska, more particularly described as follows: <br />Commencing at the southwest corner of said Southeast <br />Quarter; thence easterly along the South line of said <br />Section (10) a distance of (315) feet; thence deflecting <br />left 90° and running northerly a distance of (427.21) feet; <br />thence deflecting left 25 21' and running northwesterly <br />(644-39)o feet to the point of beginning; thence deflecting <br />right 25 31' 8nd running Northerly (698.6) feet; thence <br />deflecting 90 left and running to a point of intersection <br />with the West line of the SE 1/4 of said Section 10; thence <br />southerly parallel with the first described lice of said <br />parcel (698.6) feet; thence deflecting left 90 and running <br />to the point of beginning. <br />Mettenbrink will indemnify McIntosh for any damage to the waste <br />disposal pipe or other equipment located within the easement area. <br />McIntosh agrees to bury the waste disposal pipe on or before November <br />1, 1988. <br />Mettenbrink grants to McIntosh an easement to maintain a waste <br />water lagoon in the Northwest Quarter of the Northwest Quarter of the <br />Southeast Quarter of Section 10, Township 12 North, Range 10 West of <br />the 6th P.M. as said waste water lagoon is located on the date hereof. <br />Provided, however that said lagoon shall not intrude on the cropped <br />land as said cropped land was designated by the 1986 Agricultural <br />Stabilization and Conservation Service records. <br />The foregoing easements shall be perpetual and be binding on and <br />e re to the bene the heirs, successors and assigns of the <br />artie t . <br />(;t!�UL MCINT S LEO METZ9 r NK / <br />ELEANOR MCINIOSH P P METTENBRINK <br />STATE OF NEBRASKA <br />)ss. <br />COUNTY OF 1PA9djWI <br />The foregoin instrument was ac wledged before me on thisa /U <br />day of , 1987, by aul McIntosh and Eleanor <br />McIntosh, Husband and Wife. -t—�- <br />Not4r,f fublic <br />HMl �W / MrW <br />STATE OF NEBRASKA ) <br />)ss. <br />COUNTY OF HALL ) <br />The f r }ng instrument was dack wledged before me on the <br />day of �Ma-L , 1987, Mettenbri and <br />Jp_�e etten enbrink, H and if <br />r <br />y✓ .lic <br />P"Vins or a <br />
