Rivera <br />herein called the mortgagor whether one or more, <br />in consideration of Three- Thousand - Dollars -- ($3,000.00) <br />received from mortgagee, does mortgage to First State Bank, Shelton, Nebraska, Ttw foli!wing <br />Described property, to wit: <br />North East Quarter of the South West Quarter (NEISW;) of Section Fifteen <br />es (15), <br />In township Nine North (9), Range Twelve (12), bt of the Sixth PM, Hall County, HE <br />East Half of the Northeast Quarter, (E ;NE;), of Section Eight (8), In township <br />Nine North, (9) Range Twelve, (12)- West of the Sixth PM, Hall County, Nebraska. <br />And the mortgagor don hereby <br />assigns that with the mortgagee and with mortgagee's heirs and <br />at mortgagor is lawfully seised of said premises, that they are free from encumbrance, that <br />mortgagor has good right and lawful authority to convey the same, and that mortgagor warrants and <br />will defend the title to said premises against the lawful claims of all persona whomsoever. <br />This mortgage is given to secure the payment of the promissory note of this date made by <br />mortgagor for $ 3,000.00 payable as per farms of note of even date, and any extensions, <br />and/or renewals of said note. This mortgage is also given to secure andy and all future advances, with <br />Interest, made by mortgagee to mortgagor. Any future advances shall be made solely at the option of <br />mortgagee, and shall not exceed a total of Seventy - thousand- Dollars. (470,000.00) <br />Mortgagor shalt pay all taxes and assessments levied neon said real property and all other taxes <br />levied eta this mortgage or the note which this mortgage is given to <br />secure before the same become delin- <br />quent and shalt maintain fire, windstorm and extended coverage insurance with a mortgage clause on <br />the buildings on "mid premises in the sum of $ 30,0D0.00 <br />If mortgagor fails to pay such taxes <br />and awwssnients or procure such insurance, mortgagee, may pay- such taxes and purchase such insurance <br />and the amount w advanced with interest at nine percent per annum shall be secured by this mortgage. <br />In cane of default in the payment of the principal autn or any installment thereof or of any interest <br />thereon wheat the salve shall become due or in case of the nun - payment of any taxes or assessments, or of <br />the failure to maintain insurance as herein provided, mortgagee may at the option of mortgagee, with- <br />out notice, at anv time during the continuance of slieh default or breach, declare the who debt secured <br />be' this mortgage to i>e imtnrdiately due and payable and may foreclose this mortgage. <br />In the event of default in the performance of any of the terms and conditions of this mortgage or <br />the note secured by it. the mortgagee shall be entitled to imniedinte- possession of the property above de- <br />scribed and all the rents, revenue and income derived therefrom during such time as the mortgage in- <br />debtednrss remains unpaid shall be applied by the mortgagee to the payment of the note and all other <br />Turns secured hereby after deduction of any necessary costs of collection. <br />Dated May 11 19 87 <br />.
