<br />PUBLIC UTILITY EASEMENTS
<br />KENNETH RALSTON, Personal Representative of the ESTATE OF
<br />VESTA R. NICHOLSON, Deceased, herein called the Grantor, in
<br />consideration of Four Hundred Fifty & No /100 Dollars ($450.00),
<br />receipt of which is hereby acknowledged, hereby grants and
<br />conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right -of -way
<br />to construct, operate, maintain, extend, repair, replace, and
<br />remove public utilities, including but not limited to, sanitary
<br />sewers, pipelines, surface markers, and other appurtenances
<br />necessary for the operation and maintenance upon, in, above, and
<br />through a tract of land locted in the Southeast Quarter of the
<br />Northeast Quarter (SE -1/4 NE -1/4) of Section Two (2), Township
<br />Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall
<br />County, Nebraska, more particularly described as follows:
<br />Beginning at the Southeast corner of Lot Sixteen (16) of the
<br />Ross - Theasmeyer Subdivision; thence running northerly along
<br />the East line of said subdivision for a distance of eight
<br />hundred fifty -nine and sixty -nine hundredths (859.69) feet;
<br />thence running easterly along a line perpendicular to the
<br />East line of the Ross- Theasmeyer Subdivision for a distance
<br />of eight (8) feet; thence running southerly along a line
<br />East of and parallel to the East line of said subdivision
<br />for a distance of eight hundred fifty -nine and sixty -nine
<br />hundredths (859.69) feet; thence running westerly eight (8)
<br />feet to the point of beginning, excluding the sixty (60)
<br />feet of real property purchased as Document 84- 004886 in the
<br />office of the Register of Deeds of Hall County, said tract
<br />containing 6,398 square feet (0.147 acre), more or less, all
<br />as shown on the plat marked Exhibit "A" attached hereto and
<br />incorporated herein by reference;
<br />together with the following rights, namely, unrestricted ingress
<br />and egress under and across such land for the purpose of
<br />exercising the rights herein granted, to clear and keep clear of
<br />trees, roots, brush, and other obstructions from the surface of
<br />such tract. Any such utilities and appurtenances placed upon and
<br />under such tract of land shall remain the property of the Grantee
<br />and may be removed or replaced at any time.
<br />The Grantor, for himself, his successors and assigns, hereby
<br />covenants that no buildings, fences, or structures shall be
<br />erected, constructed, or permitted upon or underneath the tract
