_W] <br />87- 101.7'77 <br />PUBLIC UTILITY EASEMENT <br />JAMES A. CARTER and JANE RAE CARTER, husband and wife, each <br />in his and her own right and as spouse of the other, of Grand <br />Island, Nebraska, herein called the Grantors, in consideration <br />of FIFTY -EIGHT AND 07 /100 DOLLARS ($58.07) <br />receipt of which is hereby acknowledged, hereby grant and convey <br />unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation, in Hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right -of -way <br />to construct, operate, maintain, extend, repair, replace, and <br />remove public utilities, including but not limited to, sanitary <br />sewers, storm drainage system, manholes, surface markers, and <br />other appurtenances, upon, over, in, and through a tract of land <br />located in Lot Twelve (12), Capital heights Sesrenth Subdivision <br />in the City of Grand Island, Nebraska, more particularly <br />described as follows: <br />The southerly three and one -half (3 112) feet of the <br />northerly thirteen and one -half (is 112) feet of Lot 12, <br />_ Capital Heights Seventh Subdivision, said tract containing <br />401 square feet, more or less, as shorn on the drawing dated <br />10/15/84, marked Exhibit 'A' attached hereto and <br />incorporated herein by reference; <br />together with the following rights, namely, unrestricted ingress <br />- -- - and egress under, over, and across such land for the purpose of <br />exercising the rights herein granted, to clear and keep clear of <br />trees, roots, brush, and other obstructions from the surface of <br />such tract. Any such utilities and appurtenances placed upon, <br />over, and under such tract of land shall remain the property of <br />the Grantee and may be removed or replaced at any time. <br />L <br />
