PUBLIC UTILITY EASEMENT <br />87-101776 <br />FRANK F. KIOLBASA and FLORENCE A. KIOLBASA, husband and <br />wife, each in his and her own right and as spouse of the other, <br />of Grand Island, Nebraska, herein called the Grantors, in con- <br />sideration of <br />� l JZ < <br />receipt of which is hereby acknowledged, hereby grant and convey <br />unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation, in Hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right - of-way <br />to construct, operate, maintain, extend, repair, replace, and <br />remove public utilities, including but not limited to, sanitary <br />sewers, storm drainage system, manholes, surface markers, and <br />other appurtenances, upon, over, in, and through a tract of land <br />located in Lot Twenty -two (22), Capital Heights Seventh Sub- <br />division in the City of Grand Island, Nebraska, more particularly <br />described as follows: <br />The southerly three and one -half (3 1/2) feet of the <br />northerly thirteen and one -half (13 1/2) feet of Lot <br />22, Capital Heights Seventh Subdivision, said tract <br />containing 401 square feet, more or less, as shown on <br />the drawing dated 12/15/86 marked Exhibit "A" attached <br />hereto and incorporated herein by reference; <br />together with the following rights, namely, unrestricted ingress <br />and egress under, aver, and across such land for the purpose of <br />exercising the rights herein granted, to clear and keep clear of <br />trees, roots, brush, and other obstructions from the surface of <br />
