U- <br />PREFACE <br />TO <br />DEED OF TRUST WITH POWER OF SALE <br />S7- 101600 <br />Each undersianed Borrower does hereby acknowledge that: <br />1. Each Borrower has agreed to act as Trustor in <br />the DEED OF TRUST WITH POWER OF SALE to which this writing <br />is the Preface and wherein the BANK OF *ROOD RIVER at Wood <br />River, Nebraska, is the Beneficiary and which is hereinafter <br />referred to as the Trust Deed. <br />2. Each undersigned Borrower knows that by <br />virtue of the statutes of the State of Nebraska each Borrower <br />has the right to make a Designation of Homestead in the body <br />of the Trust Deed. <br />3. EACH UNDERSIGNED BORROWER DOES HEREBY DISCLAIM <br />THE RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF <br />THE TRUST DEED. <br />4. Each undersigned Borrower does hereby state <br />that no part of Borrower's homestead is presently or in the <br />future will be situated upon the real estate described in <br />the Trust Deed. Each undersigned Borrower understands this <br />to mean that whether or not the undersigned Borrower is <br />presently residing upon the real estate described in the <br />Trust Deed and whether or not each undersigned Borrower <br />hereafter establishes residence and a homestead upon any <br />part of that real estate during the time that the Trust Deed <br />remains unsatisfied and a lien upon the real estate, BORROWER <br />SHALL HAVE NO RIGHT TO MAKE A DESIGNATION OF HOMESTEAD in <br />the event of Trustee's sale under the power of sale contained <br />in the Trust Deed. <br />5. EACH UNDERSIGNED BORROWER DOES HEREBY WAIVE <br />BY THIS WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A <br />DESIGNATION OF HOMESTEAD UPON ANY PART OF THE REAL ESTATE <br />DESCRIBED IN THE TRUST DEED. Each undersigned Borrower <br />understands that the execution of this acknowledgment <br />constitutes the waiver of rights otherwise available for the <br />purpose of affording Borrower the opportunity to retain <br />Borrower's homestead in the event of a default upon the <br />Trust Deed. <br />6. Borrower represents that this Preface to Deed <br />of Trust with Power of Sale constitutes a disclaimer of <br />right to make a Designation of Homestead and a waiver of <br />right to make a declaration of homestead as provided for in <br />paragraphs 3(a) and 3(b) of Section 4 of the Nebraska Farm <br />Homestead Protection Act. Borrower directs that this Preface <br />shall be filed for record as a part of the Trust Deed in the <br />office of the Register of Deeds. <br />This Preface is being signed by us as the Borrowers and <br />as the Trustors in the Trust Deed of which this Preface is <br />a part. <br />Signed this '440 day of March, 1987. <br />Daniel E.
