DEED OF TRUST 87— 101598 <br />WITH <br />POWER OF SALE <br />THIS DEED OF TRUST WITH POWER OF SALE, made this <br />day of March, 1987, by and among JAMES D. RILEY AND SHARON <br />J. RILEY, whose mailing address is Route 3, Box 52, Wood <br />River, Nebraska 68883, (herein "Trustor "); and the BANK OF <br />WOOD RIVER, whose mailing address is 110 East 9th, Wood <br />River, Nebraska 68883, (herein "Trustee "); and the BANK OF <br />WOOD RIVER, whose mailing address is 110 East 9th, Wood <br />River, Nebraska 68883, (herein "Beneficiary "). <br />FOR VALUABLE CONSIDERATION, including the indebtedness <br />identified herein and the trust herein created, the receipt <br />of which is hereby acknowledged, Trustor irrevocably grants, <br />transfers, conveys, and assigns to Trustee, IN TRUST, WITH <br />POWER OF SALE, for the benefit and security of Beneficiary, <br />under and subject to the terms and conditions of this Deed <br />of Trust, the real property located in Hall County, Nebraska, <br />and legally described as follows: <br />An undivided one -half (15) interest in and to <br />the Southwest Quarter (SW14), and the Southeast <br />Quarter of the Northwest Quarter (SEhNwh), of <br />Section Twenty -nine (29), Township Eleven (11) <br />North, Range Twelve (12), West of the 6th P.M., <br />excepting one acre of land in a square situated <br />at the Southeast corner of said property as <br />conveyed by deed dated 11 -27 -1893 and recorded <br />in Book 22, page 150 and conveyance for road <br />purposes of a seven foot strip running along <br />the South side of said property recorded in <br />Book 150 page 380 both in Hall County records. <br />TOGETHER WITH, all rents, profits, royalties, income <br />and other benefits derived from the real property; all <br />leases or subleases covering the real property or any portion <br />thereof, now or hereafter existing or entered into, and all <br />right, title and interest of Trustor thereunder; all interests, <br />estate or other claims, both in law and in equity, which <br />Trustor now has or may hereafter acquire in the real property; <br />all easements, rights -of -way, tenements, hereditaments and <br />appurtenances thereof and thereto; all oil and gas rights <br />and profits, water rights and water stock; all right, title <br />and interest of Trustor, now owned or hereafter acquired, in <br />and to any land lying within the right -of -way of any street <br />or highway adjoining the real property, any and all buildings, <br />fixtures, improvements, and appurtenances now or hereafter <br />erected thereon or belonging thereto, (herein referred to as <br />"Improvement" or Improvements "); and any and all awards made <br />for the taking by eminent domain, or by any proceeding or <br />purchase in lieu thereof, of the whole or any part of the <br />real property. <br />All of the foregoing estate, property and interest <br />hereby conveyed to Trustee herein collectively referred to <br />a ;S the "Property"_ <br />THIS DEED OF TRUST SHALL SECURE: <br />(a) The payment of indebtedness owing and to be advanced <br />by the Bank of Wood River to Borrowers, all as evidenced by <br />Trustor's note or notes of even date herewith in the aggregate <br />principal sum of THREE HUNDRED THOUSAND AND N01100 DOLLARS <br />($300,000.00), together with interest at the rate or rates <br />provided therein, (herein, together with any and all renewals, <br />modifications, and extensions thereof, referred to as the <br />J <br />
