i r F1 PREFACE 87-- 101503 TO O lJ t� DEED OF TRUST WITH POWER OF SALE Each undersigned Borrower does hereby acknowledge that: 1. Each Borrower has agreed to act as Trustor in the DEED OF TRUST WITH POWER OF SALE to which this writing is the Preface and wherein FRED H. BOSSELMAN is the Beneficiary and which is hereinafter referred to as the Trust Deed. 2. Each undersigned Borrower knows that by virtue of the statutes of the State of Nebraska each Borrower has the right to make a Designation of Homestead in the body of the Trust Deed. 3. EACH UNDERSIGNED BORROWER DOES HEREBY DISCLAIM THE RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF THE TRUST DEED. 4. Each undersigned Borrower does hereby state that no part of Borrower's homestead is presently or in the future will be situated upon the real estate described in the Trust Deed. Each undersigned Borrower understands this to mean that whether or not the undersigned Borrower is presently residing upon the real estate described in the Trust Deed and whether or not each undersigned Borrower hereafter establishes residence and a homestead upon any part of that real estate during the time that the Trust Deed remains unsatisfied and a lien upon the real estate, BORROWER SHALL HAVE NO RIGHT TO MAKE A DESIGNATION OF HOMESTEAD in the event of Trustee's sale under the power of sale contained in the Trust Deed. 5. EACH UNDERSIGNED BORROWER DOES HEREBY WAIVE BY THIS WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A DESIGNATION OF HOMESTEAD UPON ANY PART OF THE REAL ESTATE DESCRIBED IN THE TRUST DEED. Each undersigned Borrower understands that the execution of this acknowledgment constitutes the waiver of rights otherwise available for the purpose of affording Borrower the opportunity to retain Borrower's homestead in the event of a default upon the Trust Deed. 6. Borrower represents that this Preface to Deed of Trust with Power of Sale constitutes a disclaimer of right to make a Designation of Homestead and a waiver of right to make a declaration of homestead as provided for in paragraphs 3(a) and 3(b) of Section 4 of the Nebraska Farm Homestead Protection Act. Borrower directs that this Preface shall be filed for record as a part of the Trust Deed in the office of the Register of Deeds. This Preface is being signed by me as the Borrower and as the Trustor in the Trust Deed of which this Preface is a part. Signed this /C? day of F-e464axy 1987.
