<br />WILMA L. VOSS and JACK B. VOSS, wife and husband, each in
<br />her and his own right and as spouse of the other, herein called
<br />Grantors, in consideration of Five Hundred Sixty Two and
<br />00/100 Dollars ( =562.00) -------- - ------, receipt of which is hereby
<br />acknowledged, hereby grant and convey unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right -of -way
<br />to construct, operate, maintain, extend, repair, replace, and
<br />remove public utilities, including but not limited to, sanitary
<br />sewers, pipelines, surface markers, and other appurtenances
<br />necessary for the operation and maintenance upon, in, above, and
<br />through a tract of land located in Jack Voss Horse Country Club
<br />Subdivision in the City of Grand Island, Nebraska, more
<br />particularly described as follows:
<br />The easterly five hundred eighty (580) feet of the
<br />southerly eight (8) feet of Lot Seven (7) of Jack Voss
<br />Horse Country Club Subdivision, said tract containing
<br />4,640 square feet (0.107 acre), more or less, as shown
<br />on the attached plat marked Exhibit "A" and dated
<br />11/21/84 attached hereto and incorporated herein by
<br />reference;
<br />together with the following rights, namely, unrestricted ingress
<br />and egress under and across such land for the purpose of
<br />exercising the rights herein granted, to clear and keep clear of
<br />trees, roots, brush, and other obstructions from the surface of
<br />such tract. Any such utilities and appurtenances placed upon and
<br />under such tract of land shall remain the property of the Grantee
<br />and may be removed or replaced at any time.
<br />The Grantors, for themselves, their heirs, executors,
<br />administrators, successors and assigns, hereby covenant that no
<br />buildings, fences, or structures shall be erected, constructed,
<br />or permitted upon or underneath the tract of land above described
<br />for the perpetual right -of -way and easement, and that the ease-
<br />ment herein granted shall run with the title to such tract of
<br />land and be binding upon the Grantors, their heirs, executors,
<br />administrators, successors and assigns.
